TRAINING AGREEMENT No. 001

SIA "Presto Autoskola", hereinafter referred to as the "DRIVING SCHOOL", and , hereinafter referred to as the "STUDENT", enter into this Agreement, hereinafter referred to as the Agreement:

1. SUBJECT OF THE AGREEMENT

1.1. The DRIVING SCHOOL provides the STUDENT with training for the selected category in accordance with Cabinet of Ministers Regulation No. 358 "Regulations on the Training of Vehicle Drivers and Vehicle Driver Training Programmes", hereinafter referred to as the Regulations.

1.2. Upon conclusion of the Agreement, a profile with a Presto e-konts (hereinafter - e-account) is automatically created for the STUDENT. Access to the profile: username - the STUDENT'S email address specified in the Agreement, password - the Agreement number. After logging into the system, the STUDENT changes the password.

3. PAYMENT OPTIONS FOR DRIVING SCHOOL SERVICES

3.1. The STUDENT may make payment:

3.1.1. by bank payment card;

3.1.2. by bank transfer based on the Agreement, indicating the Agreement number and purpose of payment;

3.1.3. in cash at the DRIVING SCHOOL'S office;

3.1.4. by gift card through the personalised profile on presto.lv (it is possible to pay for the theory course and top up the e-account).

4. PROCEDURE FOR THEORETICAL TRAINING

4.1. Lessons shall take place at – X, ....

4.2. Language of instruction - Latviešu.

4.3. In accordance with the Regulations, the start date of the group may be postponed if the minimum required number of persons for commencement of training is not reached. The DRIVING SCHOOL shall inform the STUDENT of the exact start date of the lessons.

4.4. If the lessons do not commence within 45 days from the signing of the Agreement, the STUDENT shall have the right to request a refund of the money paid, with or without termination of the Agreement.

Missed theory lessons

4.5. A theory lesson shall be deemed attended if the STUDENT has attended all prescribed training hours on the training day.

4.6. The STUDENT registers electronically for the make-up of missed theory lessons using the DRIVING SCHOOL'S website presto.lv, selecting the preferred make-up branch, day and time. Registration of the lesson with CSDD is carried out within 2 working days, after which the STUDENT receives a confirmation email. After receiving the email, the STUDENT is permitted to attend the registered theory lesson.

4.7. If the STUDENT is unable to attend the registered make-up lesson for a missed theory lesson, the STUDENT must cancel the registration no later than 48 hours before the beginning of the lesson; otherwise, the money paid for the lesson shall not be refunded to the STUDENT.

Driving school theory examination.

4.8. The DRIVING SCHOOL'S theory examination is organised electronically using the DRIVING SCHOOL'S website presto.lv.

4.9. The STUDENT is admitted to the theory examination provided that all obligations towards the DRIVING SCHOOL have been fulfilled, a valid medical certificate is available, and a first aid certificate is available.

4.10. The driving school's theory examination may be taken once per day. It consists of 30 questions. The STUDENT may make 1 mistake; otherwise, the examination must be retaken.

4.11. Upon arriving for the driving school's theory examination, the STUDENT presents an identity document; otherwise, the STUDENT shall not be admitted to the examination.

4.12. If the STUDENT is unable to attend the theory examination, the STUDENT must cancel it no later than 24 hours before the beginning of the examination; otherwise, the money paid for the examination shall not be refunded to the STUDENT'S e-account balance.

4.13. The STUDENT must pass the DRIVING SCHOOL'S theory examination within 1 year from registration in the CSDD training group. If the STUDENT takes the theory examination before reaching the age of 18, the STUDENT must retake it upon reaching the age of 18. In the event that the theory examination has been passed before the age of 18, the repeated registration for and taking of the first examination shall be free of charge.

4.14. The DRIVING SCHOOL enters the data into the CSDD database within 2 working days, after which taking the theory examination at CSDD becomes available, of which the STUDENT receives an informational email.

Conduct of the online examination.

4.15. The DRIVING SCHOOL'S theory examination is organised electronically using the DRIVING SCHOOL'S website presto.lv. Taking the examination in person at the Riga Central District branch may take place only by way of exception by registering by telephone nr. +371 28813188 or by email: info@presto.lv.

4.16. The STUDENT is admitted to the theory examination provided that all obligations towards the DRIVING SCHOOL have been fulfilled, a valid medical certificate is available, and a first aid certificate is available.

4.17. The driving school's theory examination may be taken once per day. It consists of 30 questions. The STUDENT may make 1 mistake; otherwise, the examination must be retaken.

4.18. For taking the examination remotely, the Cisco Webex video presentation tool on a telephone is used to provide the camera and the Any Desk computer program is used for remote completion of the examination on the driving school's computer. Therefore, both a telephone and a computer will be required simultaneously.

4.19. The Student is invited to the remote examination via the email specified in the Agreement. In the email, the Student sees the lesson time and the link to enter it. The STUDENT is prohibited from sharing the link with unauthorised persons.

4.20. Before entering the virtual examination room using the provided link, the Student is asked to indicate the first name, surname and email again. The Student indicates the true first name, surname and the email specified in the Agreement.

4.21. After entering the virtual examination room, the STUDENT places the telephone against the computer monitor or computer so that the STUDENT is clearly visible to the examiner from the front and it does not interfere with taking the examination. During the examination, the STUDENT is prohibited from taking their eyes off the monitor, turning around, leaving/abandoning the examination place, talking to other persons except the examiner, and performing any actions not related to taking the examination. At the examiner's request, the STUDENT shows the room in which they are located so that the examiner can verify the fairness of the examination.

4.22. The STUDENT presents a passport or identity card to the examiner. The examiner verifies the STUDENT'S readiness to begin the examination.

4.23. The examiner asks the STUDENTS to start the Any Desk program. The examiner gives each examinee a connection digit code via online chat, which must be entered into the Any Desk program. Shortly afterwards, the connection will be confirmed, and the STUDENT will begin taking the examination on the presto.lv website.

4.24. The STUDENT ensures full participation in the online theory examination with functioning camera and microphone, the necessary software downloaded in advance, and sufficient internet capacity. Otherwise, the examiner may refuse to conduct the online theory examination.

4.25. In the event of non-compliance with all of the above-mentioned clauses of the Agreement in the section ‘Conduct of the online examination’, the examiner may interrupt the examination, informing the STUDENT thereof and stating the reason (first time - warning, second time - disqualification from the examination), as a result of which the examination shall not be counted and must be retaken by registering for it in the manner laid down in the Agreement as a repeat examination.

4.26. After the examination, the DRIVING SCHOOL'S representative informs the STUDENT of the result of the examination.

4.27. If the STUDENT is unable to participate in the theory examination, the STUDENT must cancel it no later than 24 hours before the beginning of the examination; otherwise, the money paid for the examination shall not be refunded to the STUDENT'S e-account balance.

4.28. The DRIVING SCHOOL enters the data into the CSDD database within 2 working days, after which taking the theory examination at CSDD becomes available, of which the STUDENT receives an informational email.

4.29. A video recording is made for examination monitoring purposes. By this, the STUDENT confirms consent to such recording. The video recording shall be stored for no longer than 1 (one) month.

CSDD theory examination.

4.30. Within 3 working days after passing the DRIVING SCHOOL'S theory examination, the STUDENT must register for the CSDD theory examination and take it no later than within 20 days; otherwise, the DRIVING SCHOOL shall have the right to annul the examination result.

First aid courses (if required)

4.31. If the STUDENT does not have a first aid course certificate, the STUDENT registers for and pays for the first aid courses on the DRIVING SCHOOL'S website (https://presto.lv/en/first-aid-training) or in person at the DRIVING SCHOOL. The course assessment takes place at the end of the 2nd lesson. Persons with secondary or higher medical education, or persons studying at the relevant educational institutions, are exempt from first aid courses.

4.32. If the STUDENT is unable to attend the first aid course, the STUDENT must cancel the registration no later than 72 hours before the beginning of the course; otherwise, the money paid for the training shall not be refunded to the STUDENT.

Medical certificate (if required)

4.33. If the STUDENT does not have a driver's medical certificate, then on the DRIVING SCHOOL'S website (https://presto.lv/en/medical-certificate) the STUDENT selects a medical examination at one of the medical institutions by making an electronic application and payment (special price).

5. PROCEDURE FOR PRACTICAL TRAINING

CSDD driving training permit.

5.1. Before commencing driving lessons, the STUDENT undertakes to obtain a CSDD driving training permit in person.

Procedure for organising driving training.

5.2. Driving training is organised electronically using the DRIVING SCHOOL'S website presto.lv. Any booking of driving lessons or rescheduling thereof outside the presto.lv electronic system is prohibited.

5.3. In accordance with the procedure set out in Section 2 of the Agreement, upon receipt of the first payment, the STUDENT'S e-account balance is credited with EUR 150.00 for booking driving lessons. Additional payments shall be made in accordance with the procedure set out in Section 3.

5.4. The STUDENT carefully selects in the filters the desired lesson city, gearbox, instructor, date and category, chooses the lesson time and, taking into account the respective instructor's price list, confirms it. Once the time limit referred to in Clause 5.5. has taken effect, it will no longer be possible to correct a selection error.

5.5. If the STUDENT is unable to attend a driving lesson, the STUDENT must cancel the driving lesson no later than 24 hours before the beginning of the lesson; otherwise, the fee paid for the driving training shall not be refunded to the STUDENT'S e-account balance.

5.6. The instructor has the right to cancel the booked lesson 3 hours before the beginning of the lesson. In such case, the money for the lesson shall be refunded to the STUDENT'S e-account balance. If the lesson is cancelled less than 3 hours before the beginning of the lesson, the DRIVING SCHOOL shall compensate the lesson fee and credit the STUDENT'S balance with EUR 20.00.

Conduct of driving lessons.

5.7. Before commencing practical driving training, the STUDENT presents the CSDD driving training permit to the instructor.

5.8. For each driving lesson, the instructor makes an entry in the presto.lv profile, assessing the intensity of the lesson, the driving location, and noting the results of the training carried out.

5.9. After completion of the 10 minimum practical driving lessons (20 acad. hrs.) specified in the Regulations, depending on the STUDENT'S performance and readiness for the CSDD examination, the instructor orally informs the STUDENT of the need for additional lessons or sends the STUDENT to the DRIVING SCHOOL'S driving examination.

Driving school driving examination.

5.10. Taking the DRIVING SCHOOL'S driving examination is permitted only after the DRIVING SCHOOL'S theory examination has been passed – a corresponding mark has been made in the presto.lv profile.

5.11. The organisation and payment of the DRIVING SCHOOL'S driving examination take place in the same manner as for any driving lesson by selecting a driving instructor with whom the STUDENT has not trained before. Otherwise, it shall be counted as an ordinary driving lesson, and the instructor shall not be entitled to make a mark on the completion of driving training.

5.12. Payment for the DRIVING SCHOOL'S driving examination is made in the same way as for a driving lesson. In Riga, the STUDENT chooses the examiner in the driving lesson schedule (EKSAMINATORS RĪGA 1, 2 utt.), while outside Riga the STUDENT chooses for the examination a driving instructor with whom the STUDENT has not trained before. Otherwise, it shall be counted as an ordinary driving lesson.

5.13. The driving examination may not be delayed by more than 15 minutes. In such cases, the examination is refused because there is insufficient time for its completion. The examination fee shall not be refunded.

5.14. Within 5 working days after passing the examination, the data are entered into the CSDD database. This allows the STUDENT to take the CSDD practical examination, of which the STUDENT receives an informational email.

6. DISTANCE LEARNING

6.1. Procedure for video-based theoretical training.

6.1.1. Theory courses take place remotely, using the presto.lv platform for studies in Latvian and macam.lv for studies in Russian.

6.1.2. The STUDENT ensures sufficient internet speed (min. 20 Mbps) and a stable internet connection.

6.1.3. The STUDENT is registered in the video training group within one week from the moment of application, after which the STUDENT receives by email an invitation to join the video training platform and instructions for its use. The first login to the system must be made no later than within 5 days from receipt of the email; otherwise, the user will be blocked (contact the administration).

6.1.4. The duration of the theory course training is from 4 weeks to 1 year and consists of 11 lessons (modules). The duration of each module is 5 academic hours. It is permitted to attend 1 module per day and 3 modules per week. The theory course shall be deemed completed when all theory lessons have been attended, an assessment has been passed after each module, and the DRIVING SCHOOL'S theory examination has been passed.

6.1.5. The STUDENT attends 8 theory lessons in video training. They may be watched at a freely chosen time and pace from Monday to Sunday, except from 23:55 to 00:05 (the system performs data synchronisation with CSDD, therefore attendance will not be saved).

6.1.6. During the video lesson, the STUDENT must answer the attendance test questions (within 20 seconds); if this is not done, the video must be watched again.

6.1.7. At the end of each video lesson, a test consisting of 10 questions with one permissible mistake must be taken. The test may be taken 3 times. If the test is not passed, the relevant lesson shall not be credited and must be completed again. In the video training environment, attendance is credited on the day when the lesson assessment is passed.

6.1.8. The STUDENT attends 3 theory lessons in person. The duration of each module is 5 academic hours. A lesson shall be deemed attended if the STUDENT has attended and listened to all prescribed training hours on the training day.

6.1.9. The STUDENT registers electronically for in-person theory lessons starting from the 15th training day, using the DRIVING SCHOOL'S website presto.lv, selecting the preferred branch, day and time.

6.1.10. Registration of the lesson with CSDD is carried out within 3 working days, after which the STUDENT receives a confirmation email. Only after receipt of the email is the STUDENT permitted to attend the registered theory lesson.

Missed theory lessons

6.2. For each lesson, the driving school has access to data generated by the video presentation tool regarding each STUDENT'S participation in the lesson - day, arrival time, finishing time, duration of participation in minutes. If the DRIVING SCHOOL establishes that the STUDENT has interrupted attendance for a period exceeding 10 minutes, a note "Devies prom" is made in the driving school's and CSDD's lesson attendance register. A theory lesson shall be deemed attended if the STUDENT has attended and listened to all prescribed training hours on the training day.

6.3. The STUDENT registers electronically for the make-up of missed theory lessons using the DRIVING SCHOOL'S website presto.lv, selecting the preferred make-up branch, day and time. Registration of the lesson with CSDD is carried out within 2 working days, after which the STUDENT receives a confirmation email. After receipt of the email, the STUDENT is permitted to attend the registered theory lesson.

6.4. If the STUDENT is unable to attend the registered theory lesson (the STUDENT'S first attendance in video training, the make-up of a missed theory lesson, or a repeatedly registered make-up of a theory lesson if attendance has not taken place), the STUDENT must cancel the registration no later than 48 hours before the beginning of the lesson; otherwise, the money paid for the lesson shall not be refunded to the STUDENT.

7. LIABILITY OF THE PARTIES

7.1. By signing the Agreement, the STUDENT confirms that the STUDENT has familiarised themselves with and agrees to comply with the DRIVING SCHOOL'S internal rules.

7.2. The DRIVING SCHOOL has the right to amend the Agreement unilaterally by notifying thereof by telephone, in writing, or during theory lessons 10 days in advance.

7.3. The DRIVING SCHOOL has the right to terminate the concluded Agreement with the STUDENT without prior warning if:

7.3.1. the STUDENT fails to comply with the payment procedure (the Agreement is terminated and the data regarding course attendance are not entered into the unified CSDD database);

7.3.2. the STUDENT makes unlawful payments to the instructor for the provision of driving lessons;

7.3.3. the STUDENT has provided false information for the conclusion of the Agreement;

7.3.4. the STUDENT behaves aggressively during lessons or wilfully damages the DRIVING SCHOOL'S property. In such case, the STUDENT shall compensate the losses caused to the DRIVING SCHOOL within 3 working days; otherwise, the STUDENT undertakes additionally to pay a contractual penalty in double the value of the losses caused.

7.4. If either party terminates the Agreement before its expiry, the money paid by the STUDENT shall not be refunded, except in the case specified in Clause 8.2. of the Agreement, and access to the system shall be closed.

7.5. The STUDENT agrees, and the DRIVING SCHOOL is entitled, to process the STUDENT'S personal data (collection, storage, registration, entry, transfer to CSDD). The purpose of data processing is the registration of STUDENTS and the provision of services.

7.6. Upon reaching the age of 18, the STUDENT undertakes to handle all matters related to the training independently and directly - without the intermediation of parents, guardians, or other third parties.

7.7. The STUDENT is prohibited from making video or audio recordings during lessons.

7.8. The parties shall not be liable for non-performance of the obligations under the Agreement if caused by force majeure.

8. DISPUTE RESOLUTION PROCEDURE

8.1. If the DRIVING SCHOOL'S branch administrator or instructor fails to comply with the terms of this Agreement, the STUDENT must immediately inform the management of the DRIVING SCHOOL using the telephone number indicated in the details.

8.2. On the basis of a justified complaint by the STUDENT, the DRIVING SCHOOL refunds money for the relevant part of the training process. The STUDENT must immediately submit a written complaint. The management of the DRIVING SCHOOL shall examine it within 10 working days.

8.3. Any irreconcilable dispute arising from this Agreement shall be resolved in accordance with the procedures provided for by the laws and regulations of the Republic of Latvia.

9. RIGHT OF WITHDRAWAL

9.1. The STUDENT has the right to withdraw unilaterally from the Agreement within 14 days from the date of conclusion of the Agreement, if the service has not been used during those 14 days. In order to exercise the right of withdrawal, the STUDENT must complete a written notice of withdrawal, available electronically on the website, and submit it electronically or send it to the legal address of the DRIVING SCHOOL: Ģertrūdes iela 19/21-4, Rīga, LV – 1011, Latvija. The withdrawal form may be downloaded HERE. In order to comply with the withdrawal period, it is sufficient that the STUDENT sends the notice concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.

9.2. The right of withdrawal may not be exercised in the following cases:

9.2.1. after the expiry of the period laid down by law, i.e. 14 days;

9.2.2. if the provision of the service has been commenced.

9.3. The amount paid for the service, when exercising the right of withdrawal, shall be refunded to the STUDENT in full no later than within 21 (twenty-one) days from the moment when the DRIVING SCHOOL is informed (receives the withdrawal form) of the STUDENT'S decision to withdraw from this Agreement. The refund shall be made using the same means of payment that the STUDENT used for the initial transaction, unless the STUDENT has expressly agreed otherwise.

9.3.1. Gift cards may be used only to cover training services. Refund of money for them is not possible, but if necessary, the funds may be redirected to another person who is studying/will study at Presto Driving School.

9.4. The DRIVING SCHOOL refunds money for a service not provided if the application is made within 36 months from the moment of purchase, within the term of the Agreement.

10. OTHER PROVISIONS

10.1. The Agreement enters into force upon signing thereof. It is drawn up in 2 copies - one for the DRIVING SCHOOL and one for the STUDENT.

10.2. The term of the Agreement – 3 years.

10.3. The Agreement shall be terminated if the STUDENT has not commenced the training within 1 year from the moment of conclusion of the Agreement (Clause 9.4. enters into force)

10.4. In both cases referred to in Clause 10.3., a new training agreement is concluded for the full scope of training.
