TRAINING AGREEMENT No. 001

SIA "Presto Autoskola", hereinafter referred to as the "DRIVING SCHOOL", and , hereinafter referred to as the "STUDENT", conclude the following agreement, hereinafter referred to as the agreement:

1. SUBJECT OF THE AGREEMENT

1.1. The DRIVING SCHOOL provides the STUDENT with training for the selected category in accordance with Cabinet Regulation No. 358 "Regulations on the Training of Vehicle Drivers and Driver Training Programmes", hereinafter referred to as the Regulations.

1.2. Upon concluding the agreement, a profile with a Presto e-konts (hereinafter referred to as the e-account) is automatically created for the STUDENT. Access to the profile: username - the STUDENT'S email address specified in the agreement, password - the agreement number. After logging into the system, the STUDENT changes the password.

2. OVERVIEW OF PAYMENT PROCEDURE

Must be passed within 20 days after the end of the theory course; otherwise the examination fee is EUR 15.00. If more than 1 mistake is made, or the scheduled examination is not attended, or the examination is cancelled less than 24 hours in advance, the repeat examination fee is EUR 15.00.

2.7. 1 Driving lesson / 2 acad. hrs. 30.00 - 64.00 A minimum of 10 lessons is required. The price depends on the qualification of the selected instructor and the training vehicle (Clause 3.1. of the agreement)

3. PAYMENT OPTIONS FOR DRIVING SCHOOL SERVICES

3.1. The STUDENT may make payment:

3.1.1. by bank payment card;

3.1.2. by bank transfer on the basis of the agreement, indicating the agreement number and the purpose of payment;

3.1.3. in cash at the DRIVING SCHOOL office;

3.1.4. by gift card through the personalised profile on presto.lv (it is possible to pay for registration, the theory course, and to top up the e-account).

4. PROCEDURE FOR THEORETICAL TRAINING

4.1. Lessons will take place – X, ....

4.2. Language of instruction - Latviešu.

4.3. In accordance with the Regulations, the group start date may be postponed if there is not the minimum number of persons required to commence the training. The DRIVING SCHOOL informs the STUDENT of the exact lesson start date.

4.4. If the lessons do not commence within 45 days from the moment of signing the agreement, the STUDENT has the right to request a refund of the money paid, with or without termination of the agreement.

Missed theory lessons

4.5. A theory lesson shall be considered attended if the STUDENT has attended all the specified lesson hours on the training day.

4.6. The STUDENT books the make-up of missed theory lessons electronically, using the DRIVING SCHOOL website presto.lv, selecting the desired make-up branch, day, and time. Lesson registration with CSDD is carried out within 2 working days, after which the STUDENT receives a confirmation email. After receiving the email, the STUDENT is permitted to attend the booked theory lesson.

4.7. If the STUDENT is unable to attend the booked make-up of a missed theory lesson, it is their duty to cancel the booking no later than 48 hours before the start of the lesson; otherwise, the money paid for the lesson shall not be refunded to the STUDENT.

Driving school theory examination.

4.8. The organisation of the DRIVING SCHOOL theory examination takes place electronically, using the DRIVING SCHOOL website presto.lv.

4.9. The STUDENT is admitted to the theory examination on the condition that all obligations towards the DRIVING SCHOOL have been fulfilled, there is a valid medical certificate, and a first aid certificate is available.

4.10. The driving school theory examination may be taken once per day. It consists of 30 questions. The STUDENT may make 1 mistake; otherwise, the examination must be retaken.

4.11. Upon arriving for the driving school theory examination, the STUDENT presents an identity document; otherwise, they are not admitted to it.

4.12. If the STUDENT is unable to attend the theory examination, it is their duty to cancel it no later than 24 hours before the start of the examination; otherwise, the money paid for the examination shall not be refunded to the STUDENT'S e-account balance.

4.13. The STUDENT must pass the DRIVING SCHOOL theory examination within 1 year from registration in the training group with CSDD. If the STUDENT takes the theory examination before reaching the age of 18, they are obliged to take it again upon reaching the age of 18. In a situation where the theory examination has been passed before the age of 18, repeated booking and taking of the first examination is free of charge.

4.14. The DRIVING SCHOOL enters the data into the CSDD database within 2 working days, after which taking the theory examination at CSDD becomes available, about which the STUDENT receives an informational email.

Remote examination procedure.

4.15. The organisation of the DRIVING SCHOOL theory examination takes place electronically, using the DRIVING SCHOOL website presto.lv. Taking the examination in person at the branch in Riga Central District may take place only by exception, by arranging it by phone nr. +371 28813188 or email: info@presto.lv.

4.16. The STUDENT is admitted to the theory examination on the condition that all obligations towards the DRIVING SCHOOL have been fulfilled, there is a valid medical certificate, and a first aid certificate is available.

4.17. The driving school theory examination may be taken once per day. It consists of 30 questions. The STUDENT may make 1 mistake; otherwise, the examination must be retaken.

4.18. For remote taking of the examination, the Cisco Webex video presentation tool on a telephone to provide the camera and the Any Desk software for remote taking of the examination on the driving school computer are used. Thus, both a telephone and a computer will be required simultaneously.

4.19. The STUDENT receives an invitation to the remote examination at the email address specified in the agreement. In the email, they can see the lesson time and the link for access. The STUDENT is prohibited from sharing the link with unauthorised persons.

4.20. Before entering the virtual examination room using the provided link, the STUDENT is asked to indicate their first name, surname, and once again their email address. The STUDENT indicates their real first name, surname, and the email address specified in the agreement.

4.21. After entering the virtual examination room, the STUDENT places the telephone against the computer monitor or computer so that the STUDENT is clearly visible to the examiner from the front and this does not interfere with taking the examination. During the examination, the STUDENT is prohibited from taking their eyes off the monitor, turning around, leaving the examination place, talking to other persons except the examiner, as well as carrying out any actions not related to taking the examination. At the examiner's request, the STUDENT shows the room in which they are located so that the examiner can verify the fairness of the examination.

4.22. The STUDENT presents a passport or identity card to the examiner. The examiner verifies the STUDENT'S readiness to begin the examination.

4.23. The examiner asks the STUDENTS to start the Any Desk programme. The examiner provides each examinee with a connection code via online correspondence, which must be entered in the Any Desk programme. After a short while, the connection will be confirmed and the STUDENT will begin taking the examination on the presto.lv website.

4.24. The STUDENT ensures full participation in the remote theory examination with the possibility of ensuring the functioning of the camera and microphone, the necessary software downloaded in advance, as well as sufficient internet capacity. Otherwise, the examiner may refuse to conduct the remote theory examination.

4.25. If all the above contract clauses of the ‘’Remote examination procedure’’ section are not observed, the examiner may interrupt the examination, informing the STUDENT thereof and indicating the reason (first time - warning, second time - disqualification from the examination), as a result of which the examination will not be credited and must be retaken by registering for it in the procedure specified in the agreement as for a repeat examination.

4.26. After the end of the examination, the DRIVING SCHOOL representative informs the STUDENT of the result of the examination.

4.27. If the STUDENT cannot participate in the theory examination, it is their duty to cancel it no later than 24 hours before the start of the examination; otherwise, the money paid for the examination shall not be refunded to the STUDENT'S e-account balance.

4.28. The DRIVING SCHOOL enters the data into the CSDD database within 2 working days, after which taking the theory examination at CSDD becomes available, about which the STUDENT receives an informational email.

4.29. A video recording is made for examination control. By this, the STUDENT confirms their consent to it being made. The video recording is stored for no longer than 1 (one) month.

CSDD theory examination.

4.30. Within 3 working days after passing the DRIVING SCHOOL theory examination, the STUDENT must register for the theory examination at CSDD and take it no later than within 20 days; otherwise, the DRIVING SCHOOL has the right to cancel the examination result.

First aid courses (if necessary)

4.31. If the STUDENT does not have a first aid course certificate, they register for and pay for the first aid courses on the DRIVING SCHOOL website (https://presto.lv/en/first-aid-training) or in person at the DRIVING SCHOOL. The course assessment takes place at the end of the 2nd lesson. Persons who have secondary or higher medical education or who study at the relevant educational institutions are exempt from the first aid courses.

4.32. If the STUDENT cannot attend the first aid courses, it is their duty to cancel the booking no later than 72 hours before the start of the courses; otherwise, the money paid for the training shall not be refunded to the STUDENT.

Medical certificate (if necessary)

4.33. If the STUDENT does not have a driver's medical certificate, then on the DRIVING SCHOOL website (https://presto.lv/en/medical-certificate) the STUDENT chooses a medical commission at one of the medical institutions by making an electronic application and payment (special price).

5. PROCEDURE FOR PRACTICAL TRAINING

CSDD driving training permit.

5.1. Before starting driving lessons, the STUDENT undertakes to obtain a CSDD driving training permit in person.

Procedure for organising driving training.

5.2. Driving training is organised electronically, using the DRIVING SCHOOL website presto.lv. Any booking of driving lessons or rescheduling thereof outside the presto.lv electronic system is prohibited.

5.3. In accordance with the procedure set out in Section 2 of the agreement, after receipt of the first payment, the STUDENT'S e-account balance is topped up by EUR 150.00 for booking driving lessons. Additional payments are made in accordance with the procedure specified in Section 3.

5.4. The STUDENT carefully selects in the filters the desired lesson city, gearbox, instructor, date, and category, chooses the lesson time, and, taking into account the price list of the relevant instructor, confirms it. Once the time limit referred to in Clause 5.5. has taken effect, it will no longer be possible to correct any selection error.

5.5. If the STUDENT is unable to attend a driving lesson, it is their duty to cancel the driving lesson no later than 24 hours before the start of the lesson; otherwise, the money paid for the driving training shall not be refunded to the STUDENT'S e-account balance.

5.6. The instructor has the right to cancel the booked lesson 3 hours before the start of the lesson. In such case, the money for the lesson is returned to the STUDENT'S e-account balance. If the lesson is cancelled less than 3 hours before the start, then the DRIVING SCHOOL compensates the lesson fee and tops up the STUDENT'S balance by EUR 20.00.

Conduct of driving lessons.

5.7. Before starting practical driving training, the STUDENT presents the CSDD driving training permit to the instructor.

5.8. For each driving lesson, the instructor makes an entry in the presto.lv profile, assessing the lesson intensity, driving location, and marking the assessments of the training carried out.

5.9. After completion of the 10 minimum practical driving lessons (20 acad. hrs.) specified in the Regulations, in accordance with the STUDENT'S performance and readiness for the CSDD examination, the instructor orally informs the STUDENT of the need for additional lessons or sends the STUDENT to the DRIVING SCHOOL driving examination.

Driving school driving examination.

5.10. Taking the DRIVING SCHOOL driving examination is permissible only after the DRIVING SCHOOL theory examination has been passed — a corresponding mark has been made in the presto.lv profile.

5.11. The organisation and payment of the DRIVING SCHOOL driving examination takes place in the same way as for any driving lesson, by selecting a driving instructor with whom no training has ever taken place. Otherwise, it is counted as an ordinary driving lesson and the instructor has no right to make a mark regarding completion of the driving training.

5.12. Payment for the DRIVING SCHOOL driving examination takes place in the same way as for a driving lesson. In Riga, the STUDENT chooses an examiner in the driving lesson schedule (EXAMINER RIGA 1, 2 etc.), but outside Riga, the STUDENT chooses for examination a driving instructor with whom no training has ever taken place. Otherwise, it is counted as an ordinary driving lesson.

5.13. It is not permitted to be more than 15 minutes late for the driving examination. In such cases, the examination is refused because there is insufficient time for its completion. The examination fee is not refunded.

5.14. After passing the examination, the data are entered into the CSDD database within 2 working days. This allows the STUDENT to take the CSDD practical examination, about which the STUDENT receives an informational email.

6. DISTANCE LEARNING

6.1. Procedure for video theoretical training.

6.1.1. Theory courses take place remotely, using the presto.lv platform for studies in Latvian and macam.lv for studies in Russian.

6.1.2. The STUDENT ensures sufficient internet capacity (min. 20 Mbps) and a stable connection.

6.1.3. The STUDENT is registered in a video training group within one week from the moment of application, after which they receive an invitation by email to join the video training platform and instructions for its use. The first login to the system must be completed no later than 5 days from the moment of receipt of the email; otherwise, the user will be blocked (contact the administration).

6.1.4. The duration of theory course training is from 4 weeks to 1 year and consists of 11 lessons (modules). The duration of each module is 5 /h. It is permitted to attend 1 module per day, but 3 per week. The theory course is considered completed when all theory lessons have been attended, an assessment has been passed after each module, and the DRIVING SCHOOL theory examination has been passed.

6.1.5. The STUDENT watches 8 theory lessons in video training. They may be viewed at a freely chosen time and pace from Monday to Sunday, except from 23:55-00:05 (the system performs data synchronisation with CSDD, therefore attendance will not be saved).

6.1.6. During the video lesson, the STUDENT must answer the attendance test questions (within 20 seconds); if this is not done, the video must be watched again.

6.1.7. At the end of each video lesson, a test must be taken, consisting of 10 questions and one permissible mistake. The test may be taken 3 times. If the test is not passed, the relevant lesson is not credited and must be completed again. In the video training environment, attendance is credited on the day when the lesson assessment is passed.

6.1.8. The STUDENT attends 3 theory lessons in person. The duration of each module is 5 /h. A lesson is considered attended if the STUDENT has attended and listened to all the specified lesson hours on the training day.

6.1.9. The STUDENT books in-person theory lessons electronically starting from the 15th day of training, using the DRIVING SCHOOL website presto.lv, selecting the desired branch, day, and time.

6.1.10. Lesson registration with CSDD is carried out within 3 working days, after which the STUDENT receives a confirmation email. Only after receiving the email is the STUDENT permitted to attend the booked theory lesson.

Missed theory lessons

6.2. For each lesson, the driving school has access to data generated by the video presentation tool regarding each STUDENT'S participation in the lesson - day, arrival time, finishing time, duration of participation in minutes. If the DRIVING SCHOOL determines that the STUDENT has interrupted attendance for a period longer than 10 minutes, the entry "Left the lesson" is made in the driving school and CSDD attendance register. A theory lesson is considered attended if the STUDENT has attended and listened to all the specified lesson hours on the training day.

6.3. The STUDENT books the make-up of missed theory lessons electronically, using the DRIVING SCHOOL website presto.lv, selecting the desired make-up branch, day, and time. Lesson registration with CSDD is carried out within 2 working days, after which the STUDENT receives a confirmation email. After receiving the email, the STUDENT is permitted to attend the booked theory lesson.

6.4. If the STUDENT cannot attend the booked theory lesson (first attendance by a video training STUDENT, make-up of a missed theory lesson, or a re-booked make-up of a theory lesson if attendance has not taken place), it is their duty to cancel the booking no later than 48 hours before the start of the lesson; otherwise, the money paid for the lesson shall not be refunded to the STUDENT.

7. LIABILITY OF THE PARTIES

7.1. By signing the agreement, the STUDENT confirms that they have read and agree to comply with the DRIVING SCHOOL internal rules.

7.2. The DRIVING SCHOOL has the right to amend the agreement unilaterally, notifying thereof by telephone, in writing, or during theory lessons 10 days in advance.

7.3. The DRIVING SCHOOL has the right to terminate the concluded agreement with the STUDENT without prior notice if:

7.3.1. the STUDENT does not comply with the payment procedure (the agreement is terminated and data regarding course attendance are not entered into the unified CSDD database);

7.3.2. the STUDENT makes unlawful payments to the instructor for the conduct of driving lessons;

7.3.3. the STUDENT has provided false information for conclusion of the agreement;

7.3.4. during lessons, the STUDENT is aggressive or maliciously damages the property of the DRIVING SCHOOL. In such case, the STUDENT shall compensate the losses caused to the DRIVING SCHOOL within 3 working days; otherwise, they undertake additionally to pay a contractual penalty in double the amount of the value of the caused losses.

7.4. If either Party terminates the agreement before the expiry of the term, the money paid by the STUDENT is not refunded, except in the case specified in Clause 8.2. of the agreement, and access to the system is closed.

7.5. The STUDENT agrees and the DRIVING SCHOOL is entitled to process the STUDENT'S personal data (collection, storage, registration, input, transfer to CSDD). The purpose of data processing is student records and provision of services.

7.6. Upon reaching the age of 18, the STUDENT undertakes to deal with all matters related to the training independently and directly - without the mediation of parents, guardians, or other third parties.

7.7. The STUDENT is prohibited from making video or audio recordings during lessons.

7.8. The Parties are not liable for non-performance of the agreement obligations if this has been caused by force majeure.

8. DISPUTE RESOLUTION PROCEDURE

8.1. In the event that the branch administrator or instructor of the DRIVING SCHOOL does not comply with the terms of this agreement, the STUDENT is obliged to immediately inform the management of the DRIVING SCHOOL thereof, using the telephone indicated in the details.

8.2. On the basis of a justified complaint by the STUDENT, the DRIVING SCHOOL refunds the money for the relevant part of the training process. The student's duty is to submit a written complaint immediately. The management of the DRIVING SCHOOL shall review it within 10 working days.

8.3. An irreconcilable dispute arising from this agreement shall be resolved in accordance with the procedure laid down in the laws and regulations of the Republic of Latvia.

9. OTHER PROVISIONS

9.1. The agreement enters into force upon signing. It is drawn up in 2 copies - one for the DRIVING SCHOOL, the other for the STUDENT.

9.2. Term of the agreement – 3 years.

9.3. The agreement is terminated if the STUDENT does not pass the DRIVING SCHOOL theory examination within 1 year from registration in the training group with CSDD or does not obtain a driving licence within 3 years (the CSDD driving examination has been passed).

9.4. In both cases referred to in Clause 9.3., a new training agreement is concluded for the full scope of training.
