TRAINING AGREEMENT No. 001

SIA "Presto PP", hereinafter referred to as the "OPERATOR", and , hereinafter referred to as the "STUDENT", enter into the following agreement, hereinafter in the text – the Agreement:

1. SUBJECT OF THE AGREEMENT

1.1. The OPERATOR provides the STUDENT with the selected first aid courses. Upon successfully passing the assessment, the STUDENT receives a first aid certificate.

1.2. Persons who have secondary or higher medical education or who study at the relevant educational institutions are exempt from the first aid course for obtaining a driving licence. The relevant document must be submitted / registered in person at the JSC CSDD.

2. OVERVIEW OF PAYMENT PROCEDURE

3. PAYMENTS

3.1. The STUDENT may make payment:

3.1.1. by bank payment card;

3.1.2. by bank transfer, using the CLIENT'S connection to their personal bank to make the payment;

3.1.3. by bank transfer on the basis of the Agreement, indicating the Agreement number and the purpose of payment (subject to prior arrangement with the OPERATOR);

3.1.4. in cash at the OPERATOR'S office (subject to prior arrangement with the OPERATOR).

4. ORGANIZATIONAL PROCEDURES

4.1. Upon conclusion of the Agreement, a profile with a Presto e-konts (hereinafter – e-account) is automatically created for the STUDENT. Access to the profile: username – the STUDENT'S email address specified in the Agreement, password – the Agreement number. After logging into the system, the STUDENT changes the password. All documents related to this agreement are stored in the STUDENT'S profile.

4.2. Lessons will take place – X, ....

4.3. Language of instruction – Latviešu.

4.4. The start date may be postponed if there is not the minimum number of persons required to commence the training. The OPERATOR informs the STUDENT of the exact lesson start date.

4.5. The STUDENT registers for the first aid course on the OPERATOR'S website (https://presto.lv/en/first-aid-training) and makes payment in accordance with Section 3 of the Agreement.

4.6. If the lessons do not commence within 60 days from the moment of signing the Agreement, the STUDENT has the right to request a refund of the money paid, with or without termination of the Agreement.

4.7. If the STUDENT cannot attend the first aid course, it is their duty to cancel the booking no later than 72 hours before the start of the course; otherwise, the money paid for the training shall not be refunded to the STUDENT.

4.8. After completion of the theoretical and practical part, the STUDENT takes a knowledge assessment, upon successful completion of which a certificate of completion of the first aid course will be issued.

5. LIABILITY OF THE PARTIES

5.1. By signing the Agreement, the STUDENT confirms that they have read and agree to comply with the internal rules of the course venue.

5.2. The OPERATOR has the right to amend the Agreement unilaterally, notifying thereof in writing.

5.3. The OPERATOR has the right to terminate the concluded Agreement with the STUDENT without prior notice if:

5.3.1. the STUDENT does not comply with the payment procedure;

5.3.2. the STUDENT has provided false information for conclusion of the Agreement;

5.3.3. during lessons, the STUDENT is aggressive or maliciously damages the property of the OPERATOR. In such case, the STUDENT shall compensate the losses caused to the OPERATOR within 3 working days; otherwise, they undertake additionally to pay a contractual penalty in double the amount of the value of the caused losses.

5.4. If either Party terminates the Agreement before the expiry of the term, the money paid by the STUDENT is not refunded, except in the case specified in Clause 6.1. of the Agreement, and access to the system is closed.

5.5. The STUDENT agrees and the OPERATOR is entitled to process the STUDENT'S personal data (collection, storage, registration, input, transfer to the service provider, CSDD, NMPD). The purpose of data processing is student records and provision of services.

5.6. The STUDENT is prohibited from making video or audio recordings during lessons due to the protection of copyright in training programmes.

5.7. The OPERATOR refunds money for a service not provided if the application is made within 12 months from the moment of purchase, during the term of the Agreement.

5.8. The Parties are not liable for non-performance of the Agreement obligations if this has been caused by force majeure.

6. DISPUTE RESOLUTION PROCEDURE

6.1. On the basis of a justified complaint by the STUDENT regarding the quality of training, the OPERATOR refunds the money for the relevant part of the training process. It is the STUDENT'S duty to immediately submit a written complaint. The OPERATOR shall review it within 10 working days.

6.2. An irreconcilable dispute arising from this Agreement shall be resolved in accordance with the procedure laid down in the laws and regulations of the Republic of Latvia.

7. RIGHT OF WITHDRAWAL

7.1. The right of withdrawal cannot be exercised in the following cases:

7.1.1. if provision of the service has commenced.

7.2. The amount paid for the service, by using the right of withdrawal, shall be returned to the STUDENT in full no later than within 21 (twenty-one) days from the moment the OPERATOR is informed (receives the withdrawal form) of the STUDENT'S decision to withdraw from this Agreement. The refund shall be made using the same payment method that the STUDENT used for the initial transaction, unless the STUDENT has expressly agreed otherwise.

8. OTHER PROVISIONS

8.1. The Agreement enters into force upon signing. It is drawn up in 2 copies – one for the OPERATOR, the other for the STUDENT.

8.2. Term of the Agreement – 1 year.
