CODE 95 (PERIODIC TRAINING) DISTANCE LEARNING AGREEMENT
TRAINING AGREEMENT NO. 001 FOR CATEGORY “K95”

LLC “Presto Autoskola”, hereinafter referred to as the “DRIVING SCHOOL”, and , hereinafter referred to as the “STUDENT”, enter into the following agreement, hereinafter referred to as the “Agreement”:
1. SUBJECT OF THE AGREEMENT
1.1. The DRIVING SCHOOL shall provide the STUDENT with training for category D(95) in accordance with Article 6.1 and Article 30.1 of the Road Transport Law.
1.2. Upon conclusion of the agreement, a profile shall be automatically created for the STUDENT. Access to the profile shall be as follows: username – the STUDENT’s e-mail address specified in the agreement; password – the agreement number. Upon first login to the system, the STUDENT shall change the password. Existing clients must log into the system and then complete the registration and purchase process.
2. OVERVIEW OF PAYMENT PROCEDURES
3. PAYMENT OPTIONS
3.1. The STUDENT may make payment:
3.1.1. by bank payment card;
3.1.2. by bank transfer, using the CLIENT’s connection to their personal bank for payment execution;
3.1.3. by bank transfer, on the basis of the Agreement, indicating the Agreement number and payment purpose;
3.1.4. in cash at the DRIVING SCHOOL office;
3.1.5. by gift card through the presto.lv personalized profile (payment possible only for the theory course).
4. THEORETICAL TRAINING PROCEDURE
4.1. Lessons will take place – X, ....
4.2. Language of instruction – Latvian.
4.3. In accordance with the Regulations, the start date of the group may be postponed if the minimum number of participants required to start the training is not met. The DRIVING SCHOOL shall inform the STUDENT of the exact start date of the lessons.
4.4. If the lessons do not commence within 45 days from the date of signing the agreement, the STUDENT has the right to request a refund of the paid amount, with or without terminating the agreement.
4.5. Upon completion of the full theoretical course, a record shall be entered into the CSDD unified database confirming that the theoretical course has been completed, and the STUDENT shall receive a certificate as proof of the acquired knowledge. The certificate must be presented to the CSDD, after which a notation will be made in the driver’s licence regarding the acquisition of the “Code 95” periodic training category.
Absences from Theory Course
4.6. A theory lesson shall be considered attended if the STUDENT has participated in all scheduled academic hours on the given study day.
4.7. The STUDENT shall reschedule a missed theory lesson electronically via the DRIVING SCHOOL’s website presto.lv, selecting the preferred branch, date, and time for the make-up lesson. The lesson registration with CSDD shall be completed within 3 working days, after which the STUDENT will receive a confirmation email. Upon receipt of this email, the STUDENT is permitted to attend the scheduled make-up theory lesson.
4.8. If the STUDENT is unable to attend a registered make-up theory lesson, they must cancel the registration no later than 48 hours before the start of the lesson. Otherwise, the fee paid for the lesson shall not be refunded.
CSDD
4.9. The STUDENT shall carry out the replacement of the driver’s licence at the CSDD.
Medical Certificate (if applicable)
4.10. If the STUDENT does not possess a valid driver’s medical certificate, they must select a medical commission at a certified medical institution via the DRIVING SCHOOL website (https://presto.lv/mediciniska-izzina), submit an electronic registration, and pay the applicable fee (special rate).
5. DISTANCE LEARNING
Theoretical Training Procedure
5.1. The theoretical course consists of 12 academic hours (2 video lessons) in video format and 23 academic hours (4 in-person lessons) in classroom format. The theoretical course shall be deemed completed when all 6 lessons (35 academic hours) have been attended and credited.
5.2. A theoretical lesson in video format shall be deemed attended if the STUDENT has watched all the scheduled lesson hours and passed the assessment test at the end of the lesson. An in-person theoretical lesson shall be deemed attended if the STUDENT has participated in all scheduled lesson hours on the day of the class.
5.3. The STUDENT may attend only one in-person lesson or one video lesson per day (with the test at the end successfully passed). Otherwise, the attendance will not be credited.
Video training part of the theoretical course
5.4. The STUDENT shall ensure sufficient internet speed (minimum 12 Mbps) with a stable connection.
5.5. The STUDENT shall use equipment with sufficient capacity to watch the video lessons.
5.6. Each video lesson is available in the STUDENT's profile section “Theory Schedule.” After initial viewing, the video can be watched an unlimited number of times.
5.7. The STUDENT may watch video lessons at any time of day and from any location worldwide, determining their own learning pace. The lesson is credited as attended after the test at the end is passed.
5.8. During the video lesson, the STUDENT must respond to presence test questions (within 20 seconds). If this is not done, the video must be watched again.
5.9. At the end of each video lesson, the STUDENT must take an assessment test consisting of 10 questions with one permissible error. The test may be taken up to three times. If the test is not passed, the corresponding lesson is not credited and must be retaken. Attendance in the video training environment is credited on the day the lesson test is successfully completed.
5.10. The STUDENT is prohibited from granting access to, sharing, downloading, or otherwise transmitting any copyrighted teaching materials of the DRIVING SCHOOL to any third party.
In-person training part of the theoretical course
5.11. The STUDENT shall register for in-person theoretical lessons electronically via the DRIVING SCHOOL's website presto.lv, under the “Theory Schedule” section, selecting the desired branch, date, and time. Lesson registration in CSDD is carried out within 3 working days, after which the STUDENT receives a confirmation email. Only after receiving such email may the STUDENT attend the registered lesson.
5.12. If the STUDENT cannot attend the registered in-person lesson, they must cancel their registration no later than 48 hours before the start time. If the lesson is canceled later than 48 hours prior, or not canceled at all, the lesson will be considered unattended and re-registration shall require payment in accordance with Clause 2.5 of this Agreement.
6. RESPONSIBILITIES OF THE PARTIES
6.1. By signing this Agreement, the STUDENT confirms that they have read and agree to comply with the DRIVING SCHOOL’s internal rules and regulations.
6.2. The DRIVING SCHOOL reserves the right to unilaterally amend the Agreement by notifying the STUDENT by phone, in writing, or during theory lessons at least 10 days in advance.
6.3. The DRIVING SCHOOL has the right to terminate this Agreement with the STUDENT without prior notice if:
6.3.1. the STUDENT fails to comply with the payment procedure (the Agreement shall be terminated and the data on course attendance shall not be entered into the unified CSDD database);
6.3.2. the STUDENT has provided false information for the conclusion of the Agreement;
6.3.4. the STUDENT behaves aggressively during lessons or willfully damages the DRIVING SCHOOL’s property. In such case, the STUDENT shall compensate the DRIVING SCHOOL for the damage within 3 working days. If payment is not made within this term, the STUDENT agrees to additionally pay a contractual penalty equal to twice the value of the damages incurred.
6.4. In the event of early termination of the Agreement by either party, any payments made by the STUDENT will not be refunded, except in the case referred to in Clause 8.2 of this Agreement, and access to the system will be revoked.
6.5. The STUDENT agrees and authorizes the DRIVING SCHOOL to process their personal data (collection, storage, registration, entry, transmission to CSDD). The purpose of data processing is student registration and the provision of services.
6. The Parties shall not be held liable for failure to fulfill their obligations under this Agreement if such failure is caused by force majeure.
7. DISPUTE RESOLUTION PROCEDURE
7.1. If the branch administrator or driving instructor fails to fulfill the terms of this Agreement, the STUDENT must immediately inform the DRIVING SCHOOL management using the phone number provided in the contact details.
7.2. If the STUDENT submits a substantiated claim, the DRIVING SCHOOL shall refund the corresponding portion of the training fee. The STUDENT is required to submit a written claim without delay. The DRIVING SCHOOL’s management will review the claim within 10 working days.
7.3. Any irreconcilable disputes arising from this Agreement shall be resolved in accordance with the procedures established by the laws and regulations of the Republic of Latvia.
8. RIGHT OF WITHDRAWAL
8.1. The STUDENT has the right to unilaterally withdraw from this Agreement within 14 days from the date of its conclusion, provided that no services have been used during this 14-day period. To exercise the right of withdrawal, the STUDENT must complete a written withdrawal form available electronically on the website and submit it either electronically or send it to the legal address of the DRIVING SCHOOL: Ģertrūdes street 19/21-4, Rīga, LV–1011, Latvia. The withdrawal form can be downloaded HERE. The right of withdrawal shall be deemed exercised within the term if the STUDENT sends the notification of withdrawal before the expiry of the 14-day period.
8.2. The right of withdrawal cannot be exercised in the following cases:
8.2.1. after the statutory withdrawal period has expired, i.e., 14 days;
8.2.2. if the provision of services has already begun.
8.3. Any amounts paid by the STUDENT for services will be fully refunded within 21 (twenty-one) days from the moment the DRIVING SCHOOL is informed (receives the withdrawal form) of the STUDENT’s decision to withdraw from the Agreement. The refund will be made using the same means of payment that the STUDENT used for the initial transaction, unless the STUDENT has explicitly agreed otherwise.
8.3.1. Gift cards may be used solely for the payment of training services. Refunds for gift cards are not possible; however, if necessary, the funds may be transferred to another person who is currently enrolled or will be enrolled in Presto Driving School.
8.4. The Driving School shall refund the payment for services not rendered, provided that the request is submitted within 12 months from the date of purchase and within the term of the Agreement.
9. OTHER PROVISIONS
9.1. This Agreement enters into force upon its signing. It is drawn up in two copies – one for the DRIVING SCHOOL and one for the STUDENT.
9.2. The term of this Agreement is three years.
9.3. The Agreement shall be terminated if the STUDENT fails to pass the DRIVING SCHOOL theory exam within one year from registration in the training group at CSDD or fails to obtain a driving licence (pass the CSDD driving exam) within three years.
9.4. In both cases referred to in Clause 10.3, a new training agreement must be concluded covering the full scope of the training.
