TRAINING AGREEMENT No. 001

SIA “Presto Autoskola”, hereinafter referred to as the “DRIVING SCHOOL”, and , hereinafter referred to as the “STUDENT”, conclude the following agreement (hereinafter – the “Agreement”):

1. SUBJECT OF THE AGREEMENT

1.1. The DRIVING SCHOOL shall provide the STUDENT with training for the selected category in accordance with Cabinet Regulation No. 358 “Regulations on the Training of Vehicle Drivers and Driver Training Programmes” (hereinafter – the “Regulations”).

1.2. Upon conclusion of the Agreement, a profile with a Presto e-account (hereinafter – the “e-account”) is automatically created for the STUDENT. Profile access: username – the STUDENT’s e-mail indicated in the Agreement; password – the Agreement number. After logging in, the STUDENT must change the password.

2. OVERVIEW OF PAYMENT PROCEDURES

*The theory fee is subsidised. If training is taken only for the theory course and/or the driving training is not completed (the DRIVING SCHOOL’s practical exam is not passed) during the term of the Agreement, the STUDENT pays the full theory course price indicated.

2.6. DRIVING SCHOOL theory exam 0.00

Must be completed within 20 days from the end of the theory course; otherwise the sitting costs EUR 15.00. If more than 1 error is made, or a booked exam is not attended, or cancelled less than 24h beforehand, a repeat sitting costs EUR 15.00.

2.7. 1 driving lesson / 2 academic hours 33.00 - 74.00 At least 10 lessons required. Price depends on the chosen instructor’s qualification and the training vehicle (Clause 3.1.).
2.8. Training ground lesson / hour (manoeuvres) 2.00 - 12.50 In addition to the driving lesson price and depending on the selected training ground.

3. PAYMENT OPTIONS FOR THE DRIVING SCHOOL SERVICES

3.1. The STUDENT may pay:

3.1.1. by bank payment card;

3.1.2. by bank transfer on the basis of the Agreement, indicating the Agreement number and purpose;

3.1.3. in cash at the DRIVING SCHOOL office;

3.1.4. by gift card via the personalised profile on presto.lv (it is possible to pay for the theory course and top up the e-account).

4. THEORETICAL TRAINING PROCEDURE

4.1. Lessons will take place at – X, ....

4.2. Language of instruction – Latviešu.

4.3. In accordance with the Regulations, the group start date may be postponed if the minimum number of persons required to start training is not reached. The DRIVING SCHOOL informs the STUDENT of the exact start date of the lessons.

4.4. If the lessons do not start within 45 days from the signing of the Agreement, the STUDENT has the right to request a refund of the paid funds with or without termination of the Agreement.

Absences from theory lessons

4.5. A theory lesson is considered attended if on the training day the STUDENT has attended all prescribed study hours.

4.6. The STUDENT applies for making up missed theory lessons electronically via the DRIVING SCHOOL website presto.lv by choosing the preferred branch, day and time. Registration of the lesson in CSDD is performed within 3 working days, after which the STUDENT receives a confirmation e-mail. Only after receiving the e-mail is the STUDENT allowed to attend the registered theory lesson.

4.7. If the STUDENT cannot attend the registered make-up theory lesson, they must cancel the application no later than 48h before the lesson start; otherwise, the paid amount is not refunded.

DRIVING SCHOOL theory exam

4.8. The DRIVING SCHOOL theory exam is organised electronically via the DRIVING SCHOOL website presto.lv.

4.9. The STUDENT is admitted to the theory exam provided that all obligations to the DRIVING SCHOOL are settled, and a valid medical certificate and First Aid certificate are present.

4.10. The theory exam may be taken once per day. It consists of 30 questions. The STUDENT may make 1 mistake; otherwise, the exam must be retaken.

4.11. Upon arrival for the DRIVING SCHOOL theory exam, the STUDENT presents an identity document; otherwise, the STUDENT is not admitted.

4.12. If the STUDENT cannot attend the theory exam, they must cancel no later than 24h before the start; otherwise, the amount paid for the exam is not returned to the e-account balance.

4.13. Within 1 year from registration in the study group at CSDD the STUDENT must pass the DRIVING SCHOOL theory exam. If the theory exam is taken before the age of 18, the STUDENT must retake it upon reaching 18. If the theory exam was passed before 18, the repeated booking and retake of the primary exam is free of charge.

4.14. The DRIVING SCHOOL enters data into the CSDD database within 5 working days, after which booking the CSDD theory exam becomes available; the STUDENT receives an informational e-mail.

Online exam acceptance

4.15. The DRIVING SCHOOL theory exam is organised electronically via presto.lv. Taking the exam in person at the Riga Centre district branch may be allowed only as an exception by phone +371 28813188 or e-mail: info@presto.lv.

4.16. The STUDENT is admitted to the theory exam provided that all obligations to the DRIVING SCHOOL are settled, and a valid medical certificate and First Aid certificate are present.

4.17. The theory exam may be taken once per day. It consists of 30 questions. The STUDENT may make 1 mistake; otherwise, the exam must be retaken.

4.18. For remote taking of the exam, the following are used: Cisco Webex video-presentation tool on the phone to provide a camera and the AnyDesk desktop program for remote taking of the exam on the DRIVING SCHOOL’s computer. Therefore, both a phone and a computer are required simultaneously.

4.19. The STUDENT is invited to the remote exam to the e-mail indicated in the Agreement. The e-mail contains the lesson time and a link to join. The STUDENT is prohibited from sharing the link with third parties.

4.20. Before entering the virtual exam room via the link, the STUDENT indicates their name, surname and e-mail again. The STUDENT must indicate their real name and surname and the e-mail indicated in the Agreement.

4.21. After joining, the STUDENT positions the phone against the computer monitor or the computer so that the STUDENT is clearly visible to the examiner from the front and the device does not interfere with taking the exam. During the exam, the STUDENT is prohibited from averting the gaze from the monitor, turning around, leaving/abandoning the exam place, talking to other persons (except the examiner), and performing any actions not related to taking the exam. Upon the examiner’s request, the STUDENT shows the room to ensure exam integrity.

4.22. The STUDENT presents a passport or ID to the examiner. The examiner checks the STUDENT’s readiness to start the exam.

4.23. The examiner asks STUDENTS to start the AnyDesk program. The examiner provides each candidate, via chat, a numeric connection code to be entered in AnyDesk. After a short moment, the connection will be approved and the STUDENT starts the exam on presto.lv.

4.24. The STUDENT ensures full participation in the online exam with working camera and microphone, the necessary software downloaded in advance, and sufficient internet speed. Otherwise, the examiner may refuse to accept the online theory exam.

4.25. If any of the points in the section “Online exam acceptance” are not observed, the examiner may terminate the exam, informing the STUDENT and indicating the reason (first time – warning, second time – disqualification), as a result of which the exam will not be credited and must be retaken following the Agreement procedure for a repeat exam.

4.26. After the end of the exam, a representative of the DRIVING SCHOOL informs the STUDENT of the exam result.

4.27. If the STUDENT cannot participate in the theory exam, they must cancel no later than 24h before the start; otherwise, the amount paid is not returned to the e-account balance.

4.28. The DRIVING SCHOOL enters data into the CSDD database within 5 working days, after which booking the CSDD theory exam becomes available; the STUDENT is notified by e-mail.

4.29. A video recording is made for exam control. The STUDENT hereby consents to its making. The recording is stored for no more than 1 (one) month.

CSDD theory exam

4.30. Within 3 working days after passing the DRIVING SCHOOL theory exam, the STUDENT must book the CSDD theory exam and take it no later than within 20 days; otherwise, the DRIVING SCHOOL has the right to annul the result.

First Aid courses (if required)

4.31. If the STUDENT does not have a First Aid certificate, they register and pay for the First Aid course on the DRIVING SCHOOL website (https://presto.lv/pirma-palidziba-kursi) or in person at the DRIVING SCHOOL. The course pass is assessed at the end of the 2nd lesson. Persons with secondary or higher medical education or studying in the relevant educational institutions are exempt.

4.32. If the STUDENT cannot attend the First Aid course, they must cancel no later than 72h before the start; otherwise, the fee paid is not refunded.

Medical certificate (if required)

4.33. If the STUDENT does not have a driver’s medical certificate, the STUDENT selects a medical commission at one of the medical institutions on the DRIVING SCHOOL website (https://presto.lv/mediciniska-izzina), submitting an electronic application and payment (special price).

5. PRACTICAL TRAINING PROCEDURE

CSDD learner’s driving permit

5.1. Before starting driving lessons, the STUDENT undertakes to obtain a learner’s driving permit at CSDD in person.

Organisation of driving training

5.2. The organisation of driving lessons is carried out electronically via the DRIVING SCHOOL website presto.lv. Any booking or rescheduling of driving lessons outside the presto.lv electronic system is prohibited.

5.3. According to Section 2 of the Agreement, after receipt of the first advance, the STUDENT’s e-account balance is credited with EUR 150.00 for ordering driving lessons. Further top-ups take place in accordance with Section 3.

5.4. Using filters, the STUDENT carefully selects the city, gearbox, instructor, date and category, chooses the lesson time and, taking into account the respective instructor’s price list, confirms it. Once the term referred to in Clause 5.5. occurs, it will no longer be possible to correct the choice.

5.5. If the STUDENT cannot attend a driving lesson, they must cancel no later than 24h before the start; otherwise, the amount paid for the training is not returned to the e-account balance.

5.6. The instructor has the right to cancel the booked lesson up to 3h before the start. In such a case, the fee is returned to the e-account balance. If the cancellation occurs less than 3h before the start, the DRIVING SCHOOL compensates the lesson fee and additionally tops up the STUDENT’s balance by EUR 20.00.

Conduct of driving lessons

5.7. Before starting practical training, the STUDENT presents the CSDD learner’s driving permit to the instructor.

5.8. For each driving lesson, the instructor makes an entry in the presto.lv profile evaluating the lesson intensity, driving location and marking assessments of the training provided.

5.9. After completing the 10 minimum practical driving lessons (20 academic hours) specified in the Regulations, and depending on the STUDENT’s performance and readiness for the CSDD exam, the instructor informs the STUDENT verbally about the need for additional lessons or refers them to the DRIVING SCHOOL practical exam.

DRIVING SCHOOL practical exam

5.10. Taking the DRIVING SCHOOL practical exam is permitted only after passing the DRIVING SCHOOL theory exam – a corresponding mark is made in the presto.lv profile.

5.11. The DRIVING SCHOOL practical exam is organised and paid like any driving lesson by choosing a driving instructor with whom no training has previously been taken. Otherwise, it is counted as a regular driving lesson and the instructor has no right to mark the completion of practical training.

5.12. Payment is as for a driving lesson. In Riga, the STUDENT selects an examiner in the driving lessons schedule (EKSAMINATORS RĪGA 1, 2, etc.), while outside Riga the STUDENT selects for examination a driving instructor with whom no training has previously been taken. Otherwise, it is counted as a regular driving lesson.

5.13. Being late for the exam for more than 15 minutes is not allowed due to insufficient time to complete it. The exam fee is non-refundable.

5.14. After passing the exam, the data are entered into the CSDD database within 5 working days. This allows the STUDENT to take the CSDD practical exam; the STUDENT receives an informational e-mail.

6. DISTANCE LEARNING

6.1. Video theory training procedure.

6.1.1. Theory courses take place remotely, using the platform presto.lv for studies in Latvian and macam.lv for studies in Russian.

6.1.2. The STUDENT ensures sufficient internet speed (min. 20 Mbps) with a stable connection.

6.1.3. The STUDENT is registered in a video training group within one week from application, after which an invitation to join the video platform and user instructions are sent by e-mail. The first login must be made no later than 5 days from receipt of the e-mail; otherwise, the user will be blocked (contact the administration).

6.1.4. The duration of the theory course is from 4 weeks to 1 year and consists of 11 lessons (modules). Each module lasts 5 academic hours. It is allowed to attend 1 module per day and up to 3 modules per week. The theory course is considered completed when all theory lessons have been attended, the assessment after each module has been passed, and the DRIVING SCHOOL theory exam has been passed.

6.1.5. The STUDENT listens to 8 theory lessons in video training. They can be watched at a freely chosen time and pace from Monday to Sunday, except 23:55–00:05 (the system performs data synchronisation with CSDD; attendance will not be saved).

6.1.6. During the video lesson, the STUDENT must answer presence test questions (within 20 seconds); otherwise, the video must be listened to again.

6.1.7. At the end of each video lesson, a test consisting of 10 questions with one permissible mistake must be taken. The test may be taken 3 times. If the test is not passed, the lesson is not credited and must be completed again. In the video environment, attendance is credited on the day the lesson assessment is passed.

6.1.8. The STUDENT attends 3 theory lessons in person. Each module lasts 5 academic hours. A lesson is considered attended if, on the training day, the STUDENT has attended and listened to all prescribed study hours.

6.1.9. The STUDENT registers for in-person theory lessons electronically starting from the 15th training day via presto.lv by selecting the preferred branch, day and time.

6.1.10. Registration in CSDD is performed within 3 working days, after which the STUDENT receives a confirmation e-mail. Only after receiving the e-mail is the STUDENT allowed to attend the registered theory lesson.

Absences in the theory course

6.2. For each lesson the video tool provides data on the STUDENT’s participation – day, time of arrival, end time, duration in minutes. If the DRIVING SCHOOL establishes that the STUDENT has interrupted attendance for more than 10 minutes, a note “Left” is made in the DRIVING SCHOOL and CSDD attendance journals. A theory lesson is considered attended if the STUDENT has attended and listened to all prescribed study hours in the training day.

6.3. The STUDENT registers missed theory lesson make-ups electronically via presto.lv by selecting the branch, day and time. Registration in CSDD is done within 3 working days, after which a confirmation e-mail is sent. Only after receiving the e-mail may the STUDENT attend the lesson.

6.4. If the STUDENT cannot attend a registered theory lesson (first attendance for a video-training STUDENT, a make-up of a missed theory lesson, or a repeatedly registered make-up if attendance was not completed), the STUDENT must cancel no later than 48h before the start; otherwise, the amount paid for the lesson is not refunded.

First Aid courses (if required)

6.5. If the STUDENT does not have a First Aid certificate, the STUDENT registers and pays for the course at https://presto.lv/pirma-palidziba-kursi. The theory is held remotely using Cisco Webex.

6.6. The STUDENT ensures full participation in distance learning with camera and microphone capability provided by the computer or phone (built-in or peripheral devices); otherwise, attendance will not be credited.

6.7. The STUDENT receives the invitation to the remote lesson to the e-mail indicated in the Agreement. If 72 hours before the lesson no e-mail has been received, the STUDENT must immediately contact the DRIVING SCHOOL to resolve the issue.

6.8. The STUDENT tries to join in good time (10–30 min before the start) to avoid last-minute technical issues that may hinder full participation. In case of problems, the STUDENT immediately contacts the administration at +371 28813188, info@presto.lv.

6.9. Before entering the virtual training room using the link, the STUDENT indicates their name, surname and e-mail. The data must match those indicated in the Agreement.

6.10. The instructor starts the lesson by marking attendance in the attendance journal.

6.11. If the STUDENT cannot attend the First Aid course, they must cancel no later than 48h before the start; otherwise, the fee paid is not refunded.

6.12. Persons with secondary or higher medical education or studying in relevant educational institutions are exempt from the First Aid course.

6.13. After the theory part, the DRIVING SCHOOL sends the STUDENT information about the place and time of the practice part. The STUDENT understands that it may be postponed until the end of the state of emergency and will not make claims against the DRIVING SCHOOL. After the practice part, the STUDENT will immediately be issued a certificate of completion of the First Aid course.

7. LIABILITY OF THE PARTIES

7.1. By signing the Agreement, the STUDENT confirms that they have read and agree to comply with the DRIVING SCHOOL internal rules.

7.2. The DRIVING SCHOOL has the right to unilaterally amend the Agreement, notifying by phone, in writing or during theory lessons 10 days in advance.

7.3. The DRIVING SCHOOL has the right to terminate the Agreement with the STUDENT without prior notice if:

7.3.1. the STUDENT fails to comply with the payment procedure (the Agreement is terminated and the attendance data are not entered into the unified CSDD database);

7.3.2. the STUDENT makes illegal payments to an instructor for driving lessons;

7.3.3. the STUDENT has provided false information for the conclusion of the Agreement;

7.3.4. the STUDENT is aggressive during lessons or maliciously damages the DRIVING SCHOOL’s property. In such a case, the STUDENT shall pay the DRIVING SCHOOL the damages within 3 working days; otherwise, the STUDENT undertakes to additionally pay a contractual penalty in double the amount of the damage.

7.4. If either party terminates the Agreement before term, the amounts paid by the STUDENT are not refunded, except in the case specified in Clause 8.2. of the Agreement, and access to the system is closed.

7.5. The STUDENT agrees and the DRIVING SCHOOL is entitled to process the STUDENT’s personal data (collection, storage, registration, entry, transfer to CSDD). The purpose of processing is student registration and provision of services.

7.6. The STUDENT is prohibited from making video or audio recordings during lessons.

7.7. The Parties are not liable for non-performance of the Agreement obligations if caused by force majeure.

8. DISPUTE RESOLUTION PROCEDURE

8.1. If a branch administrator or instructor of the DRIVING SCHOOL does not fulfil the terms of this Agreement, the STUDENT must immediately inform the DRIVING SCHOOL management using the phone indicated in the details.

8.2. Upon a justified claim by the STUDENT, the DRIVING SCHOOL returns the money for the corresponding part of the training process. The STUDENT must submit a written claim immediately. The DRIVING SCHOOL management reviews it within 10 working days.

8.3. Any unresolved dispute arising from this Agreement shall be resolved in accordance with the laws of the Republic of Latvia.

9. RIGHT OF WITHDRAWAL

9.1. The STUDENT has the right to unilaterally withdraw from the Agreement within 14 days from the date of conclusion of the Agreement if the service has not been used during these 14 days. To exercise the right of withdrawal, the STUDENT must complete a written withdrawal form available electronically on the website and submit it electronically or send it to the DRIVING SCHOOL’s legal address: Ģertrūdes iela 19/21-4, Rīga, LV – 1011, Latvia. The withdrawal form can be downloaded HERE. To meet the withdrawal deadline, it is sufficient to send the notice of exercising the right of withdrawal before the period expires.

9.2. The right of withdrawal cannot be used in the following cases:

9.2.1. after the statutory period has expired, i.e. 14 days;

9.2.2. if the provision of the service has begun.

9.3. The amount paid for the service when exercising the right of withdrawal will be refunded to the STUDENT in full no later than within 21 (twenty-one) days from when the DRIVING SCHOOL is informed (receives the withdrawal form) of the STUDENT’s decision to withdraw from this Agreement. The refund will be made using the same means of payment that the STUDENT used for the initial transaction, unless the STUDENT has clearly agreed otherwise.

9.3.1. Gift cards can be used only to pay for training services. A refund for them is not possible, but, if necessary, the money can be redirected to another person studying/who will study at Presto Autoskola.

9.4. The DRIVING SCHOOL refunds money for a service not provided if the application is made within 36 months from the time of purchase, within the term of the Agreement.

10. OTHER PROVISIONS

10.1. The Agreement enters into force upon signature. It is drawn up in 2 copies – one for the DRIVING SCHOOL, the other – for the STUDENT.

10.2. Term of the Agreement – 3 years.

10.3. The Agreement is terminated if the STUDENT has not started training within 1 year from the date of conclusion of the Agreement (Clause 9.4. applies).

10.4. In both cases in Clause 10.3., a new training agreement is concluded for the full scope of training.
