DRIVING TRAINING AGREEMENT No. 001 for category “B”

SIA "Presto Autoskola", hereinafter referred to as the “DRIVING SCHOOL”, and , hereinafter referred to as the “STUDENT”, conclude the following agreement, hereinafter referred to as the Agreement:

1. SUBJECT OF THE AGREEMENT

1.1. The DRIVING SCHOOL provides the STUDENT with training for the selected category in accordance with Cabinet Regulation No. 358 “Regulations on the Training of Vehicle Drivers and Driver Training Programmes”, hereinafter referred to as the Regulations.

1.2. Upon concluding the Agreement, a profile with a Presto e-konts (hereinafter referred to as the e-account) is automatically created for the STUDENT. Access to the profile: username — the STUDENT’S email address specified in the Agreement, password — the Agreement number. After logging into the system, the STUDENT changes the password.

2. OVERVIEW OF THE PAYMENT PROCEDURE

3. PAYMENT OPTIONS FOR DRIVING SCHOOL SERVICES

3.1. The STUDENT may make payment:

3.1.1. by bank payment card;

3.1.2. by bank transfer on the basis of the Agreement, indicating the Agreement number and the purpose of payment;

3.1.3. in cash at the DRIVING SCHOOL office;

4. ADDITIONAL SERVICES

First aid courses (if required)

4.1. If the STUDENT does not have a first aid course certificate, they register for and pay for the first aid courses on the DRIVING SCHOOL website (https://presto.lv/pirma-palidziba-kursi) or in person at the DRIVING SCHOOL. The course assessment takes place at the end of the second lesson. Persons who have secondary or higher medical education or who study at the relevant educational institutions are exempt from the first aid courses.

4.2. If the STUDENT cannot attend the first aid course, they must cancel the booking no later than 48 hours before the start of the course; otherwise, the fee paid for the training is not refunded.

Medical certificate (if required)

4.3. If the STUDENT does not have a driver’s medical certificate, the STUDENT chooses a medical commission on the DRIVING SCHOOL website (https://presto.lv/mediciniska-izzina) at one of the medical institutions by making an electronic application and payment (special price).

5. PROCEDURE FOR PRACTICAL TRAINING

CSDD driving training permit.

5.1. Before starting driving lessons, the STUDENT undertakes to obtain a CSDD driving training permit in person.

Procedure for organising driving training.

5.2. Driving training is organised electronically using the DRIVING SCHOOL website presto.lv.

5.3. The STUDENT tops up the profile e-account for booking driving lessons in accordance with the procedure specified in Section 3.

5.4. The STUDENT carefully selects in the filters the desired lesson city, gearbox, instructor, date, and category, chooses the lesson time and confirms it taking into account the relevant instructor’s price list. Once the time limit referred to in Clause 5.5. has taken effect, it will no longer be possible to correct a selection error.

5.5. If the STUDENT is unable to attend a driving lesson, they must cancel the driving lesson no later than 24 hours before the start of the lesson; otherwise, the money paid for the driving training is not refunded to the STUDENT’S e-account balance.

5.6. The instructor has the right to cancel the booked lesson no later than 12 hours before the start of the lesson. In such case, the money for the lesson is returned to the STUDENT’S e-account balance. If the lesson cancellation takes place less than 12 hours before the start, the DRIVING SCHOOL compensates the lesson fee and tops up the STUDENT’S balance by EUR 20.00.

5.7. The money paid into the e-account may only be used for booking driving lessons.

Conduct of driving lessons.

5.8. Before starting practical driving training, the STUDENT presents the CSDD driving training permit and the training card to the instructor. This is issued by the relevant driving school where the STUDENT acquires theoretical knowledge for obtaining a driving licence, after attending the part of the theoretical training course prescribed by the Regulations.

5.9. The STUDENT brings the driving training process record journal to each lesson, which is issued to the STUDENT by the DRIVING SCHOOL (at the office or by the instructor). The instructor makes an entry regarding the date of the lesson and the work completed during the lesson.

5.10. In order to obtain a driving licence, after completion of the minimum 10 practical driving lessons (20 acad./h) required by the Regulations, and in accordance with the STUDENT’S performance and readiness for the CSDD examination, the instructor orally informs the STUDENT of the need for additional lessons or sends the STUDENT to the DRIVING SCHOOL driving examination.

Driving school driving examination (for obtaining a driving licence).

5.11. Taking the DRIVING SCHOOL driving examination is permissible only after the DRIVING SCHOOL theory examination has been passed — a corresponding mark has been made in the training card.

5.12. Payment for the DRIVING SCHOOL driving examination takes place in the same way as for a driving lesson. In Riga, the STUDENT chooses an examiner in the driving lesson schedule (EXAMINER RIGA 1, 2 etc.), but outside Riga, the STUDENT chooses for examination a driving instructor with whom no training has ever taken place. Otherwise, it is counted as an ordinary driving lesson.

5.13. It is not permitted to be more than 15 minutes late for the driving examination. In such cases, the examination is refused because there is insufficient time to complete it. The examination fee is not refunded.

5.14. After successfully passing the DRIVING SCHOOL driving examination, the examiner signs the confirmation of completion of driving training by making a mark in the training card.

6. LIABILITY OF THE PARTIES.

6.1. By signing the Agreement, the STUDENT confirms that they have read and agree to comply with the DRIVING SCHOOL internal rules.

6.2. The DRIVING SCHOOL has the right to amend the Agreement unilaterally by notifying the STUDENT by telephone or in writing 10 days in advance.

6.3. The DRIVING SCHOOL has the right to terminate the Agreement concluded with the STUDENT without prior notice if:

6.3.1. the STUDENT makes unlawful payments to the instructor for conducting driving lessons;

6.3.2. the STUDENT has provided false information for conclusion of the Agreement;

6.3.3. during lessons, the STUDENT is aggressive or maliciously damages the property of the DRIVING SCHOOL. In such case, the STUDENT shall compensate the losses caused to the DRIVING SCHOOL within 3 working days; otherwise, the STUDENT undertakes additionally to pay a contractual penalty in double the amount of the value of the losses caused.

6.4. If either Party terminates the Agreement before expiry of the term, the money paid by the STUDENT is not refunded, except in the case specified in Clause 7.2. of the Agreement, and access to the system is closed.

6.5. The STUDENT agrees and the DRIVING SCHOOL is entitled to process the STUDENT’S personal data (collection, storage, registration, entry, transfer to CSDD). The purpose of data processing is student records and provision of services.

6.6. The Parties are not liable for non-performance of the obligations under the Agreement if this has been caused by force majeure.

7. DISPUTE RESOLUTION PROCEDURE.

7.1. In the event that the branch administrator of the DRIVING SCHOOL or the instructor does not comply with the terms of this Agreement, the STUDENT is obliged to immediately inform the management of the DRIVING SCHOOL thereof using the telephone indicated in the details.

7.2. On the basis of a justified complaint by the STUDENT, the DRIVING SCHOOL refunds the money for the relevant part of the training process. The STUDENT is obliged to submit a written complaint immediately. The management of the DRIVING SCHOOL shall review it within 10 working days.

7.3. An irreconcilable dispute arising from this Agreement shall be resolved in accordance with the procedure laid down in the laws and regulations of the Republic of Latvia.

8. RIGHT OF WITHDRAWAL

8.1. The STUDENT has the right to unilaterally withdraw from the Agreement within 14 days from the date of concluding the Agreement if the service has not been used during those 14 days or if a period of less than 24 hours has not yet commenced for cancellation of a driving lesson (Clause 5.5. of the Agreement). In order to exercise the right of withdrawal, the STUDENT must complete a written withdrawal form, which is available electronically on the website, and submit it electronically or send it to the legal address of the DRIVING SCHOOL: Ģertrūdes iela 19/21-4, Rīga, LV – 1011, Latvija. The withdrawal form can be downloaded HERE. In order for the withdrawal period to be complied with, it is sufficient that the STUDENT sends their notification regarding the exercise of the right of withdrawal before the expiry of the withdrawal period.

8.2. The right of withdrawal cannot be exercised in the following cases:

8.2.1. after expiry of the term laid down by law, i.e. 14 days;

8.2.2. if provision of the service has commenced.

8.3. The amount paid for the service, by using the right of withdrawal, shall be returned to the STUDENT in full no later than within 21 (twenty-one) days from the moment the DRIVING SCHOOL is informed (receives the withdrawal form) of the STUDENT’S decision to withdraw from this Agreement. The refund shall be made using the same payment method that the STUDENT used for the initial transaction, unless the STUDENT has expressly agreed otherwise.

9. OTHER PROVISIONS.

9.1. The Agreement enters into force upon signing. It is drawn up in 2 copies — one for the DRIVING SCHOOL, the other for the STUDENT.

9.2. The term of the Agreement shall be no longer than 3 years from the date of commencement of the theory course registered with CSDD.
