TRAINING AGREEMENT No. 001 for category “A1”

SIA ”Presto Autoskola”, hereinafter referred to as the “DRIVING SCHOOL”, and , hereinafter referred to as the "STUDENT", enter into the following agreement, hereinafter in the text – the Agreement:

1. SUBJECT OF THE AGREEMENT

1.1. The DRIVING SCHOOL provides the STUDENT with training for the selected category in accordance with Cabinet Regulation No. 358 “Regulations Regarding the Training of Vehicle Drivers and Vehicle Driver Training Programmes”, hereinafter - the Regulations.

1.2. Upon conclusion of the Agreement, a profile with a Presto e-konts (hereinafter - e-account) is automatically created for the STUDENT. Access to the profile: username - the STUDENT’S email address specified in the Agreement, password - the Agreement number. After logging into the system, the STUDENT changes the password.

1.3. During a state of emergency declared by the State, Clauses 4.5., 4.6., 4.7., 4.8., 4.9., 4.10., 4.11., 4.12. of the Agreement and the subsection “First aid courses” of Section 4 shall cease to apply.

2. OVERVIEW OF PAYMENT PROCEDURE

2.5. First payment for driving lessons 150.00 Must be paid to the DRIVING SCHOOL within 14 days from the moment of conclusion of the Agreement. It is added to the e-account balance for booking driving lessons
2.6. Driving school theory examination 0.00

Must be passed within 20 days after the end of the theory course; otherwise, the examination fee is EUR 15.00. If more than 1 mistake is made, or the scheduled examination is not attended, or the examination is cancelled less than 24 hours in advance, the repeat examination fee is EUR 15.00.

2.7. 1 Driving lesson / 2 acad. hrs. 43.00 - 55.00 A minimum of 5 lessons is required. The price depends on the qualification of the selected instructor and the training vehicle

3. PAYMENT OPTIONS FOR DRIVING SCHOOL SERVICES

3.1. The STUDENT may make payment:

3.1.1. by bank payment card;

3.1.2. by bank transfer on the basis of the Agreement, indicating the Agreement number and the purpose of payment;

3.1.3. in cash at the DRIVING SCHOOL office;

4. PROCEDURE FOR THEORETICAL TRAINING

4.1. Lessons will take place – X, ....

4.2. Language of instruction - Latviešu.

4.3. In accordance with the Regulations, the group start date may be postponed if there is not the minimum number of persons required to commence the training. The DRIVING SCHOOL informs the STUDENT of the exact lesson start date.

4.4. If the lessons do not commence within 45 days from the moment of signing the Agreement, the STUDENT has the right to request a refund of the money paid, with or without termination of the Agreement.

Missed theory lessons

4.5. A theory lesson shall be considered attended if the STUDENT has attended all the specified lesson hours on the training day.

4.6. The STUDENT books the make-up of missed theory lessons electronically, using the DRIVING SCHOOL website presto.lv, selecting the desired make-up branch, day, and time. Lesson registration with CSDD is carried out within 3 working days, after which the STUDENT receives a confirmation email. After receiving the email, the STUDENT is permitted to attend the booked theory lesson.

4.7. If the STUDENT is unable to attend the booked make-up of a missed theory lesson, it is their duty to cancel the booking no later than 48 hours before the start of the lesson; otherwise, the money paid for the lesson shall not be refunded to the STUDENT.

Driving school theory examination.

4.8. The organisation of the DRIVING SCHOOL theory examination takes place electronically, using the DRIVING SCHOOL website presto.lv.

4.9. The STUDENT is admitted to the theory examination on the condition that all obligations towards the DRIVING SCHOOL have been fulfilled, there is a valid medical certificate, and a first aid certificate is available.

4.10. The driving school theory examination may be taken once per day. It consists of 30 questions. The STUDENT may make 1 mistake; otherwise, the examination must be retaken.

4.11. Upon arriving for the driving school theory examination, the STUDENT presents an identity document; otherwise, they are not admitted to it.

4.12. The DRIVING SCHOOL enters the data into the CSDD database within 2 working days, after which taking the theory examination at CSDD becomes available, about which the STUDENT receives an informational email.

Online examination procedure

4.13. The organisation of the DRIVING SCHOOL theory examination takes place electronically, using the DRIVING SCHOOL website presto.lv. Taking the examination in person at the branch in Riga Central District may take place only by exception, by arranging it by phone nr. +371 28813188 or email: info@presto.lv.

4.14. The STUDENT is admitted to the theory examination on the condition that all obligations towards the DRIVING SCHOOL have been fulfilled, there is a valid medical certificate, and a first aid certificate is available.

4.15. The driving school theory examination may be taken once per day. It consists of 30 questions. The STUDENT may make 0 mistakes; otherwise, the examination must be retaken.

4.16. For remote taking of the examination, the Cisco Webex video presentation tool on a telephone to provide the camera and the Any Desk software for remote taking of the examination on the driving school computer are used. Thus, both a telephone and a computer will be required simultaneously.

4.17. The student receives an invitation to the remote examination at the email address specified in the Agreement. In the email, they can see the lesson time and the link for access. The STUDENT is prohibited from sharing the link with unauthorised persons.

4.18. Before entering the virtual examination room using the provided link, the student is asked to indicate their first name, surname, and once again their email address. The student indicates their real first name, surname, and the email address specified in the Agreement.

4.19. After entering the virtual examination room, the STUDENT places the telephone against the computer monitor or computer so that the STUDENT is clearly visible to the examiner from the front and this does not interfere with taking the examination. During the examination, the STUDENT is prohibited from taking their eyes off the monitor, turning around, leaving the examination place, talking to other persons except the examiner, as well as carrying out any actions not related to taking the examination. At the examiner's request, the STUDENT shows the room in which they are located so that the examiner can verify the fairness of the examination.

4.20. The STUDENT presents a passport or identity card to the examiner. The examiner verifies the STUDENT’S readiness to begin the examination.

4.21. The examiner asks the STUDENTS to start the Any Desk programme. The examiner provides each examinee with a connection code via online correspondence, which must be entered in the Any Desk programme. After a short while, the connection will be confirmed and the STUDENT will begin taking the examination on the CSDD website in the relevant category.

4.22. The STUDENT ensures full participation in the online theory examination with the possibility of ensuring the functioning of the camera and microphone, the necessary software downloaded in advance, as well as sufficient internet capacity. Otherwise, the examiner may refuse to conduct the online theory examination.

4.23. If all the above contract clauses of the “Online examination procedure” section are not observed, the examiner may interrupt the examination, informing the STUDENT thereof and indicating the reason (first time - warning, second time - disqualification from the examination), as a result of which the examination will not be credited and must be retaken by registering for it in the procedure specified in the Agreement as for a repeat examination.

4.24. After the end of the examination, the DRIVING SCHOOL representative informs the STUDENT of the result of the examination.

4.25. If the STUDENT cannot participate in the theory examination, it is their duty to cancel it no later than 24 hours before the start of the examination; otherwise, the money paid for the examination shall not be refunded to the STUDENT’S e-account balance.

4.26. The DRIVING SCHOOL enters the data into the CSDD database within 5 working days, after which taking the theory examination at CSDD becomes available, about which the STUDENT receives an informational email.

4.27. A video recording is made for examination control. By this, the STUDENT confirms their consent to it being made. The video recording is stored for no longer than 1 (one) month.

CSDD theory examination.

4.28. After receiving the informational email, the STUDENT takes the CSDD theory examination within 3 working days, or retakes the driving school examination 3 working days before the planned CSDD examination.

First aid courses (if required)

4.29. If the STUDENT does not have a first aid course certificate, they register for and pay for the first aid courses on the DRIVING SCHOOL website mājas lapā (https://presto.lv/en/first-aid-training) or in person at the DRIVING SCHOOL. The course assessment takes place at the end of the 2nd lesson. Persons who have secondary or higher medical education or who study at the relevant educational institutions are exempt from the first aid courses.

4.30. If the STUDENT cannot attend the first aid course, it is their duty to cancel the booking no later than 48 hours before the start of the course; otherwise, the money paid for the training shall not be refunded to the STUDENT.

Medical certificate (if required)

4.31. If the STUDENT does not have a driver's medical certificate, then on the DRIVING SCHOOL website (https://presto.lv/en/medical-certificate) the STUDENT chooses a medical commission at one of the medical institutions by making an electronic application and payment (special price).

5. PROCEDURE FOR PRACTICAL TRAINING

Procedure for organising driving training.

5.1. Driving training is organised electronically, using the DRIVING SCHOOL website presto.lv.

5.2. In accordance with the procedure set out in Section 2 of the Agreement, after receipt of the payment the STUDENT’S profile e-account is topped up by EUR 100.00 for booking driving lessons. Additional payments are made in accordance with the procedure specified in Section 3.

5.3. The STUDENT chooses the desired lesson time and instructor (confirming it while taking into account the price list of the relevant instructor).

5.4. If the STUDENT is unable to attend a driving lesson, it is their duty to cancel the driving lesson no later than 24 hours before the start of the lesson; otherwise, the money paid for the driving training shall not be refunded to the STUDENT’S e-account balance.

5.5. The instructor has the right to cancel the booked lesson 12 hours before the start of the lesson. In such case, the money for the lesson is returned to the STUDENT’S e-account balance. If the lesson is cancelled less than 12 hours before the start, then the DRIVING SCHOOL compensates the lesson fee and tops up the STUDENT’S balance by EUR 20.00.

Conduct of driving lessons.

5.6. Before starting practical driving training, the STUDENT presents the instructor with the CSDD driving training permit and the driving training process record journal.

5.7. For each lesson, the STUDENT brings along the driving training process record journal issued to the STUDENT by the DRIVING SCHOOL (at the office or by the instructor). The instructor makes an entry regarding the lesson date and the work completed during the lesson.

5.8. After completion of the 5 minimum practical driving lessons (10 acad./h) specified in the Regulations, in accordance with the STUDENT’S performance and readiness for the CSDD examination, the instructor orally informs the STUDENT about the need for additional lessons or sends them to the DRIVING SCHOOL driving examination.

Driving school driving examination.

5.9. Taking the DRIVING SCHOOL driving examination is permissible only after the DRIVING SCHOOL theory examination has been passed – a corresponding mark has been made in the presto.lv profile.

5.10. The organisation and payment of the DRIVING SCHOOL driving examination takes place in the same way as for any driving lesson, by selecting a driving instructor with whom no training has ever taken place. Otherwise, it is counted as an ordinary driving lesson and the instructor has no right to make a mark regarding completion of the driving training.

5.11. Upon arriving for the lesson, the student informs the instructor that instead of the lesson they wish to take the examination. When it has been successfully passed, the examiner fills in the report in the presto.lv profile, which serves as confirmation of completion of the driving training.

5.12. After the examination, the report is available in the student profile section "Dokumenti". The examination results may be challenged within 5 days by submitting a complaint to the driving school in the form of an application.

5.13. After passing the examination, the data are entered into the CSDD database within 5 working days. This allows the STUDENT to take the CSDD practical examination, about which the STUDENT receives an informational email.

6. LIABILITY OF THE PARTIES

6.1. By signing the Agreement, the STUDENT confirms that they have read and agree to comply with the DRIVING SCHOOL internal rules.

6.2. The DRIVING SCHOOL has the right to amend the Agreement unilaterally, notifying thereof by telephone, in writing, or during theory lessons 10 days in advance.

6.3. The DRIVING SCHOOL has the right to terminate the concluded Agreement with the STUDENT without prior notice if:

6.3.1. the STUDENT does not comply with the payment procedure;

6.3.2. the STUDENT makes unlawful payments to the instructor for the conduct of driving lessons;

6.3.3. the STUDENT has provided false information for conclusion of the Agreement;

6.3.4. during lessons, the STUDENT is aggressive or maliciously damages the property of the DRIVING SCHOOL. In such case, the STUDENT shall compensate the losses caused to the DRIVING SCHOOL within 3 working days; otherwise, they undertake additionally to pay a contractual penalty in double the amount of the value of the caused losses.

6.4. If either Party terminates the Agreement before the expiry of the term, the money paid by the STUDENT is not refunded, except in the case specified in Clause 7.2. of the Agreement, and access to the system is closed.

6.5. The STUDENT agrees and the DRIVING SCHOOL is entitled to process the STUDENT’S personal data (collection, storage, registration, input, transfer to CSDD). The purpose of data processing is student records and provision of services.

6.6. The Parties are not liable for non-performance of the Agreement obligations if this has been caused by force majeure.

7. DISPUTE RESOLUTION PROCEDURE

7.1. In the event that the branch administrator or instructor of the DRIVING SCHOOL does not comply with the terms of this Agreement, the STUDENT is obliged to immediately inform the management of the DRIVING SCHOOL thereof, using the telephone indicated in the details.

7.2. On the basis of a justified complaint by the STUDENT, the DRIVING SCHOOL refunds the money for the relevant part of the training process. It is the student’s duty to immediately submit a written complaint. The management of the DRIVING SCHOOL shall review it within 10 working days.

7.3. An irreconcilable dispute arising from this Agreement shall be resolved in accordance with the procedure laid down in the laws and regulations of the Republic of Latvia.

8. RIGHT OF WITHDRAWAL

8.1. The STUDENT has the right to unilaterally withdraw from the Agreement within 14 days from the date of conclusion of the Agreement if the service has not been used during these 14 days. In order to exercise the right of withdrawal, the STUDENT must complete a written withdrawal form, which is available electronically on the website, and submit it electronically or send it to the legal address of the DRIVING SCHOOL: Ģertrūdes iela 19/21-4, Rīga, LV – 1011, Latvija. The withdrawal form can be downloaded HERE. In order for the withdrawal period to be complied with, it is sufficient that the STUDENT sends their notification regarding the exercise of the right of withdrawal before the expiry of the withdrawal period.

8.2. The right of withdrawal cannot be exercised in the following cases:

8.2.1. after expiry of the term laid down by law, i.e. 14 days;

8.2.2. if provision of the service has commenced.

8.3. The amount paid for the service, by using the right of withdrawal, shall be returned to the STUDENT in full no later than within 21 (twenty-one) days from the moment the DRIVING SCHOOL is informed (receives the withdrawal form) of the STUDENT’S decision to withdraw from this Agreement. The refund shall be made using the same payment method that the STUDENT used for the initial transaction, unless the STUDENT has expressly agreed otherwise.

9. OTHER PROVISIONS

9.1. The Agreement enters into force upon signing. It is drawn up in 2 copies - one for the DRIVING SCHOOL, the other for the STUDENT.

9.2. Term of the Agreement – 3 years.

9.3. The Agreement is terminated if the STUDENT has not passed the DRIVING SCHOOL theory examination within 1 year from registration in the training group with CSDD or has not obtained a driving licence within 3 years (the CSDD practical examination has been passed).

9.4. In both cases referred to in Clause 9.3., a new training agreement is concluded for the full scope of training.

9.7. By pressing the button CONCLUDE THE AGREEMENT, the Parties have concluded this Distance Agreement.

10. DISTANCE LEARNING

PROCEDURE FOR THEORETICAL TRAINING

10.1. Theory courses take place remotely, using the Cisco Webex video presentation tool.

10.2. The STUDENT ensures full participation in distance learning with the possibility of using the camera and microphone provided by the computer's or telephone's built-in or additional (peripheral) equipment or functionality, as well as sufficient internet capacity; otherwise, attendance will not be credited.

10.3. The STUDENT receives an invitation to the first remote lesson at the email address specified in the Agreement. In the email, they can see the lesson time and the link for access. The link for each following lesson will be available in the STUDENT’S profile in the section "Teorijas nodarbības" next to each lesson, therefore no claims regarding non-receipt of the link by email for any reason shall be accepted.

10.4. The STUDENT should try to join the lesson in good time (10-30 minutes before it starts) in order to avoid last-minute technical problems that could prevent full participation in the lesson. In the event of problems, the STUDENT shall immediately contact the driving school administration by phone nr. +371 28813188 and email info@presto.lv.

10.5. Before entering the virtual training room using the received link, the STUDENT indicates their first name, surname, and email address. The indicated data must correspond to those specified in the Agreement.

10.6. The lecturer begins the lesson by marking the STUDENTS’ attendance in the driving school’s and CSDD’s attendance journal.

10.7. A video recording is made for lesson control. By this, the STUDENT confirms their consent to it being made. The video recording is stored for no longer than 1 (one) month.

10.8. Remote theoretical training takes place during a state of emergency declared in the country. After the end of the state of emergency, theoretical training will take place in person at the selected branch of the driving school.

10.9. The STUDENT is prohibited from sharing information that would allow a third person to participate in distance learning.

Missed theory lessons

10.10. For each lesson, the driving school has access to data generated by the video presentation tool regarding each STUDENT’S participation in the lesson - day, arrival time, finishing time, duration of participation in minutes. If the DRIVING SCHOOL determines that the STUDENT has interrupted attendance for a period longer than 10 minutes, the entry "Left the lesson" is made in the driving school and CSDD attendance register. A theory lesson is considered attended if the STUDENT has attended and listened to all the specified lesson hours on the training day.

10.11. The STUDENT books the make-up of missed theory lessons electronically, using the DRIVING SCHOOL website presto.lv, selecting the desired make-up branch, day, and time. Lesson registration with CSDD is carried out within 2 working days, after which the STUDENT receives a confirmation email. After receiving the email, the STUDENT is permitted to attend the booked theory lesson.

10.12. If the STUDENT is unable to attend the booked make-up of a missed theory lesson, it is their duty to cancel the booking no later than 48 hours before the start of the lesson; otherwise, the money paid for the lesson shall not be refunded to the STUDENT.

First aid courses (if required)

10.13. If the STUDENT does not have a first aid course certificate, they register for and pay for the first aid courses on the DRIVING SCHOOL website (https://presto.lv/en/first-aid-training). Theory courses take place remotely, using the Cisco Webex video presentation tool.

10.14. The STUDENT ensures full participation in distance learning with the possibility of using the camera and microphone provided by the computer's or telephone's built-in or additional (peripheral) equipment or functionality; otherwise, attendance will not be credited.

10.15. The STUDENT receives an invitation to the remote lesson at the email address specified in the Agreement. In the email, they can see the lesson time and the link for access. If the STUDENT has not received an invitation email 48 hours before the start of the lesson, it is their duty to immediately contact the DRIVING SCHOOL to resolve the issue.

10.16. The STUDENT should try to join the lesson in good time (10-30 minutes before it starts) in order to avoid last-minute technical problems that could prevent full participation in the lesson. In the event of problems, the STUDENT shall immediately contact the driving school administration by phone nr. +371 28813188 and email info@presto.lv.

10.17. Before entering the virtual training room using the received link, the STUDENT indicates their first name, surname, and email address. The indicated data must correspond to those specified in the Agreement.

10.19. If the STUDENT cannot attend the first aid course, it is their duty to cancel the booking no later than 48 hours before the start of the course; otherwise, the money paid for the training shall not be refunded to the STUDENT.

10.20. Persons who have secondary or higher medical education or who study at the relevant educational institutions are exempt from the first aid courses.

10.21. After attending the theoretical part, the driving school sends the STUDENT information about the place and time of the practical part. The STUDENT is aware that this may be delayed until the end of the state of emergency and therefore will not raise any claims against the driving school. After completion of the practical part, the STUDENT will immediately be issued a certificate confirming completion of the first aid course.
