DRIVING TRAINING AGREEMENT No. 001 for category “A1”

2025, 14. august

LLC “Presto Autoskola”, hereinafter referred to as the “DRIVING SCHOOL”, and , hereinafter referred to as the “STUDENT”, enter into the following agreement, hereinafter referred to as the “Agreement”:

 

1. SUBJECT OF THE AGREEMENT

1.1. The DRIVING SCHOOL shall provide the STUDENT with training for the selected category in accordance with Cabinet Regulation No. 358 “Regulations on the Training of Vehicle Drivers and Driver Training Programmes” (hereinafter – the “Regulations”).

1.2. Upon conclusion of this Agreement, a profile is automatically created for the STUDENT. Profile access: username – the STUDENT’s email address specified in the Agreement; password – the Agreement number. Upon first login, the STUDENT must change the password.

1.3. During a state of emergency declared by the government, the provisions of Clauses 4.5., 4.6., 4.7., 4.8., 4.9., 4.10., 4.11., 4.12. and the subsection “First Aid Courses” of Section 4 shall be deemed void.

3. PAYMENT OPTIONS FOR DRIVING SCHOOL SERVICES

3.1. The STUDENT may make payments:

3.1.1. by bank card;

3.1.2. by bank transfer referencing the Agreement, indicating the Agreement number and purpose;

3.1.3. in cash at the DRIVING SCHOOL office;

 

4. THEORETICAL TRAINING PROCEDURE

4.1. Lessons will take place – X, ....

4.2. Language of instruction – Latviešu.

4.3. In accordance with the Regulations, the start date of the group may be postponed if the minimum number of participants required to start the training is not met. The DRIVING SCHOOL shall inform the STUDENT of the exact start date of the lessons.

4.4. If the lessons do not commence within 45 days from the date of signing the Agreement, the STUDENT has the right to request a refund of the paid amount, with or without terminating the Agreement.

 

Absences from the theory course

4.5. A theory lesson is considered attended if the STUDENT has attended all scheduled academic hours on the given study day.

4.6. The STUDENT shall schedule a make-up theory lesson electronically via the DRIVING SCHOOL’s website presto.lv, selecting the desired branch, day and time. Registration of the lesson with CSDD is completed within 3 working days, after which the STUDENT receives a confirmation email. Only after receiving this email is the STUDENT allowed to attend the scheduled theory lesson.

4.7. If the STUDENT cannot attend a scheduled make-up theory lesson, the STUDENT must cancel no later than 48h before the start of the lesson; otherwise, the paid amount will not be refunded.

 

DRIVING SCHOOL theory examination.

4.8. The DRIVING SCHOOL theory examination is scheduled electronically via the DRIVING SCHOOL website presto.lv.

4.9. The STUDENT is admitted to the theory examination provided that all obligations to the DRIVING SCHOOL are fulfilled and a valid medical certificate and first aid certificate are provided.

4.10. The DRIVING SCHOOL theory examination may be taken once per day. It consists of 30 questions. The STUDENT may make 1 mistake; otherwise, the examination must be retaken.

4.11. Upon arrival for the DRIVING SCHOOL theory examination, the STUDENT must present a personal identification document; otherwise, the STUDENT will not be admitted.

4.12. The DRIVING SCHOOL enters data into the CSDD database within 5 working days, after which registration for the theory exam at CSDD becomes available; the STUDENT receives an informative email.

 

Online examination procedure

4.13. The DRIVING SCHOOL theory examination is organised electronically via the DRIVING SCHOOL website presto.lv. On-site examination at the Riga Central District branch is allowed only by way of exception by registering via phone +371 28813188 or email: info@presto.lv.

4.14. The STUDENT is admitted to the theory examination provided that all obligations to the DRIVING SCHOOL are fulfilled and a valid medical certificate and first aid certificate are provided.

4.15. The DRIVING SCHOOL theory examination may be taken once per day. It consists of 30 questions. The STUDENT may make 0 mistakes; otherwise, the examination must be retaken.

4.16. For remote examination, Cisco Webex is used via phone to provide the camera feed and the Any Desk program is used to take the exam remotely on the DRIVING SCHOOL computer. Therefore, both a phone and a computer are required simultaneously.

4.17. The STUDENT is invited to the remote exam via the email specified in the Agreement. The email shows the time and a link to join. The STUDENT is prohibited from sharing the link with unauthorised persons.

4.18. Before entering the virtual examination room using the link, the STUDENT is asked to enter their name, surname and email again. The STUDENT must enter their real name, surname and the email provided in the Agreement.

4.19. After entering the virtual examination room, the STUDENT props the phone against the computer monitor or computer so that the STUDENT is clearly visible to the examiner from the front and it does not disturb completing the exam. During the exam, the STUDENT is prohibited from diverting their gaze from the monitor, turning, leaving the exam place, talking to other persons except the examiner, or carrying out any activities not related to the exam. At the examiner’s request, the STUDENT shows the room they are in so the examiner can ensure exam integrity.

4.20. The STUDENT presents a passport or ID card to the examiner. The examiner ensures the STUDENT is ready to start the exam.

4.21. The examiner asks STUDENTS to start the Any Desk program. The examiner provides each examinee with a numeric connection code via online chat, which must be entered in Any Desk. After a moment, the connection is confirmed and the STUDENT starts the exam on the CSDD website for the relevant category.

4.22. The STUDENT ensures full participation in the online theory exam with a functioning camera and microphone, the required software downloaded in advance, and sufficient internet bandwidth. Otherwise, the examiner may refuse to accept the online exam.

4.23. Failure to comply with all points of the “online examination procedure” may result in the examiner stopping the exam, informing the STUDENT of the reason (first time – warning, second time – disqualification). As a result, the exam will not be counted and must be retaken by registering again in accordance with the Agreement.

4.24. After the end of the exam, a DRIVING SCHOOL representative informs the STUDENT of the result.

4.25. If the STUDENT cannot participate in the theory exam, they must cancel no later than 24h before the start; otherwise, the fee paid for the exam will not be refunded to the STUDENT’s e-account balance.

4.26. The DRIVING SCHOOL enters the data into the CSDD database within 5 working days, after which taking the theory exam at CSDD becomes available; the STUDENT receives an informative email.

4.27. A video recording is made for exam control. The STUDENT hereby consents to such recording. The video is stored for no more than one (1) month.

 

CSDD theory examination.

4.28. After receiving the informative email, the STUDENT takes the CSDD theory exam within 3 working days, or retakes the DRIVING SCHOOL exam 3 working days before the planned CSDD exam.

 

First Aid courses (if needed)

4.29. If the STUDENT does not have a first aid course certificate, they register and pay for the first aid course on the DRIVING SCHOOL website (https://presto.lv/pirma-palidziba-kursi) or in person at the DRIVING SCHOOL. The course assessment is at the end of the 2nd lesson. Persons with secondary or higher medical education or studying at the respective educational institutions are exempt from first aid courses.

4.30. If the STUDENT cannot attend the first aid course, they must cancel no later than 48h before the start; otherwise, the fee paid for training will not be refunded.

 

Medical certificate (if needed)

4.31. If the STUDENT does not have a driver’s medical certificate, then on the DRIVING SCHOOL website (https://presto.lv/mediciniska-izzina) the STUDENT selects a medical commission at a medical institution by submitting an electronic application and payment (special price).

 

5. PRACTICAL TRAINING PROCEDURE

CSDD driving instruction permit (if needed)

5.1. Before starting driving lessons, the STUDENT undertakes to obtain a driving instruction permit at CSDD in person.

 

Organisation of driving training.

5.2. Driving training is organised electronically via the DRIVING SCHOOL website presto.lv.

5.3. The STUDENT tops up the profile e-account balance for booking driving lessons in accordance with Section 3.

5.4. The STUDENT selects the desired lesson time and instructor (confirming the respective instructor’s price list).

5.5. If the STUDENT cannot attend a driving lesson, the lesson must be cancelled no later than 24h before the start; otherwise, the amount paid will not be refunded to the STUDENT’s e-account balance.

5.6. The instructor has the right to cancel the scheduled lesson up to 12h before the start. In such a case, the amount for the lesson is returned to the STUDENT’s e-account balance. If cancellation occurs less than 12h before, the DRIVING SCHOOL compensates the lesson fee and additionally credits EUR 20.00 to the STUDENT’s balance.

5.7. Funds paid into the e-account may be used only for booking driving lessons.

 

Conduct of driving lessons.

5.8. Before starting practical driving instruction, the STUDENT presents to the instructor the driving permit and the training card. It is issued by the respective driving school where the STUDENT obtains the theoretical knowledge for the driver’s licence after listening to the theoretical part required by the Regulations.

5.9. The STUDENT brings the driving training record logbook to each lesson, issued by the DRIVING SCHOOL (at the office or by the instructor). The instructor records the lesson date and what was covered.

5.10. For obtaining a driver’s licence, after completing the 5 minimum practical driving lessons (10 academic hours) specified in the Regulations, depending on the STUDENT’s performance and readiness for the CSDD exam, the instructor verbally informs the STUDENT about the need for additional lessons or refers the STUDENT to the DRIVING SCHOOL driving exam.

 

DRIVING SCHOOL practical driving exam (for obtaining a driver’s licence).

5.11. Taking the DRIVING SCHOOL driving exam is allowed only after passing the DRIVING SCHOOL theory exam – with a corresponding mark in the training card.

5.12. The DRIVING SCHOOL driving exam is scheduled and paid for like any driving lesson by selecting “Driving exam” instead of an instructor. When successfully passed, the examiner signs the certificate of completion of driving training by marking it in the training card.

 

5. PRACTICAL TRAINING PROCEDURE

Organisation of driving training.

5.1. Driving training is organised electronically via the DRIVING SCHOOL website presto.lv.

5.2. In accordance with Section 2 of the Agreement, the STUDENT’s profile e-account is credited with EUR 100.00 for booking driving lessons after receipt of payment. Additional top-ups are made as set out in Section 3.

5.3. The STUDENT selects the desired lesson time and instructor (confirming the respective instructor’s price list).

5.4. If the STUDENT cannot attend a driving lesson, the STUDENT must cancel no later than 24h before the start; otherwise, the amount paid for the lesson will not be refunded to the STUDENT’s e-account balance.

5.5. The instructor has the right to refuse the scheduled lesson up to 12h before the start. In such a case, the amount for the lesson is returned to the STUDENT’s e-account balance. If cancellation occurs less than 12h before, the DRIVING SCHOOL compensates the lesson fee and additionally credits EUR 20.00 to the STUDENT’s balance.

5.7. The STUDENT brings the driving training record logbook to each lesson, issued by the DRIVING SCHOOL (at the office or by the instructor). The instructor records the lesson date and what was covered.

5.8. After completing the 5 minimum practical driving lessons (10 academic hours) specified in the Regulations, based on the STUDENT’s performance and readiness for the CSDD exam, the instructor verbally informs the STUDENT about the need for additional lessons or refers the STUDENT to the DRIVING SCHOOL driving exam.

 

DRIVING SCHOOL practical driving exam.

5.9. Taking the DRIVING SCHOOL driving exam is allowed only after passing the DRIVING SCHOOL theory exam – with a corresponding mark in the presto.lv profile.

5.10. The DRIVING SCHOOL driving exam is organised and paid for like any driving lesson, selecting a driving instructor with whom the STUDENT has not had instruction. Otherwise, it is counted as a regular driving lesson and the instructor has no right to mark completion of the driving training.

5.11. Upon arrival for the lesson, the STUDENT informs the instructor that they wish to take the exam instead of a lesson. When successfully passed, the examiner fills in the protocol in the presto.lv profile, which is the confirmation of completion of the driving training.

5.12. After the exam, the protocol is available in the “Documents” section of the STUDENT’s profile. The exam results may be contested within 5 days by submitting a written claim to the DRIVING SCHOOL.

5.13. After passing the exam, the data is entered into the CSDD database within 5 working days. This allows the STUDENT to take the CSDD practical exam, about which the STUDENT receives an informative email.

 

6. RESPONSIBILITIES OF THE PARTIES.

6.1. By signing the Agreement, the STUDENT confirms that they have read and agree to comply with the DRIVING SCHOOL’s internal rules.

6.2. The DRIVING SCHOOL has the right to unilaterally amend the Agreement by notifying by phone, in writing or during theoretical lessons 10 days in advance.

6.3. The DRIVING SCHOOL has the right to terminate the concluded Agreement with the STUDENT without prior notice if:

6.3.1. the STUDENT fails to comply with the payment procedure;

6.3.2. the STUDENT makes unlawful payments to the instructor for driving lessons;

6.3.3. the STUDENT has provided false information for concluding the Agreement;

6.3.4. the STUDENT behaves aggressively during lessons or maliciously damages DRIVING SCHOOL property. In such a case, the STUDENT shall pay the DRIVING SCHOOL for the losses within 3 working days; otherwise, the STUDENT undertakes to pay a contractual penalty equal to double the amount of the losses.

6.4. If either party terminates the Agreement before the term, the amounts paid by the STUDENT are not refunded, except in the case specified in Clause 7.2, and access to the system is closed.

6.5. The STUDENT agrees and the DRIVING SCHOOL is entitled to process the STUDENT’s personal data (collection, storage, registration, entry, transfer to CSDD). The purpose of data processing is student registration and provision of services.

6.6. The Parties are not liable for failure to perform the obligations of the Agreement if caused by force majeure.

 

7. DISPUTE RESOLUTION PROCEDURE.

7.1. If the DRIVING SCHOOL branch administrator or instructor fails to comply with the terms of this Agreement, the STUDENT must immediately inform the DRIVING SCHOOL management using the phone number indicated in the details.

7.2. Based on a justified claim from the STUDENT, the DRIVING SCHOOL refunds the payment for the relevant part of the training process. The STUDENT must submit a written claim without delay. The DRIVING SCHOOL management reviews it within 10 working days.

7.3. Any irreconcilable dispute arising from this Agreement shall be resolved in accordance with the procedures laid down by the laws and regulations of the Republic of Latvia.

 

8. RIGHT OF WITHDRAWAL

8.1. The STUDENT has the right to unilaterally withdraw from the Agreement within 14 days from the date of its conclusion if the service has not been used during these 14 days. To exercise the right of withdrawal, the STUDENT must complete a written withdrawal form available electronically on the website and submit it electronically or send it to the DRIVING SCHOOL’s legal address: Ģertrūdes iela 19/21-4, Rīga, LV – 1011, Latvia. The withdrawal form can be downloaded HERE. The withdrawal period is observed if the STUDENT sends the notification before the end of the 14-day period.

8.2. The right of withdrawal cannot be exercised in the following cases:

8.2.1. after the statutory period has expired, i.e. 14 days;

8.2.2. if the provision of services has begun.

8.3. The amount paid for the service will be refunded in full no later than 21 (twenty-one) days after the DRIVING SCHOOL is informed (receives the withdrawal form) of the STUDENT’s decision to withdraw from the Agreement. The refund will be made using the same means of payment used for the original transaction, unless the STUDENT has clearly agreed otherwise.

 

9. OTHER PROVISIONS.

9.1. The Agreement enters into force upon signature. It is drawn up in 2 copies – one for the DRIVING SCHOOL and one for the STUDENT.

9.2. The term of the Agreement – 3 years.

9.3. The Agreement is terminated if the STUDENT fails to pass the DRIVING SCHOOL theory exam within 1 year from registration in the training group at CSDD or fails to obtain a driver’s licence (pass the CSDD driving exam) within 3 years.

9.4. In both cases in Clause 9.3, a new training agreement is concluded for the full scope of training.

9.7. By clicking the SIGN AGREEMENT button, the Parties have concluded this Distance Agreement.

 

10. DISTANCE LEARNING

THEORETICAL TRAINING PROCEDURE

10.1. Theory courses are conducted remotely using the Cisco Webex video presentation tool.

10.2. The STUDENT ensures full participation in distance learning with a camera and microphone via a computer or phone (built-in or peripheral devices) and sufficient internet bandwidth; otherwise, attendance will not be recorded.

10.3. The STUDENT receives an invitation to the first remote lesson at the email specified in the Agreement. The email shows the lesson time and link to join. Links for each subsequent lesson will be available in the STUDENT’s profile under “Theory lessons” next to each lesson; therefore, no claims about not receiving the link by email for any reason will be accepted.

10.4. The STUDENT should join on time (10–30 minutes before the start) to avoid last-minute technical problems that could hinder full participation. In case of problems, the STUDENT immediately contacts the DRIVING SCHOOL administration by phone +371 28813188 and email info@presto.lv.

10.5. Before entering the virtual classroom using the link, the STUDENT enters their name, surname and email. The data must match the Agreement.

10.6. The instructor starts the lesson by marking attendance in the DRIVING SCHOOL and CSDD attendance registers.

10.7. A video recording is made for lesson control. The STUDENT hereby consents to such recording. The video is stored for no more than one (1) month.

10.8. Theoretical training via distance learning is conducted during a state of emergency declared in the country. When the state of emergency ends, theoretical training will be conducted in person at the selected DRIVING SCHOOL branch.

10.9. The STUDENT is prohibited from sharing information that allows a third party to participate in distance learning.

 

Absences from the theory course

10.10. For each lesson, the DRIVING SCHOOL has access to data generated by the video presentation tool on each STUDENT’s participation – day, time of entry, time of leaving, duration in minutes. If the DRIVING SCHOOL finds that the STUDENT has been absent for more than 10 minutes, the entry “Left the session” is recorded in the DRIVING SCHOOL and CSDD attendance logs. A theory lesson is considered attended if the STUDENT has attended and listened to all scheduled lessons on that day.

10.11. The STUDENT schedules a make-up theory lesson electronically via the DRIVING SCHOOL website presto.lv, selecting the desired branch, day and time. Registration with CSDD is completed within 3 working days, after which the STUDENT receives a confirmation email. Only after receiving the email is the STUDENT permitted to attend the selected theory lesson.

10.12. If the STUDENT cannot attend the scheduled make-up theory lesson, the STUDENT must cancel the application no later than 48h before the start; otherwise, the amount paid will not be refunded.

 

First Aid courses (if needed)

10.13. If the STUDENT does not have a first aid course certificate, the STUDENT registers and pays for the first aid course on the DRIVING SCHOOL website (https://presto.lv/pirma-palidziba-kursi). Theory classes are conducted remotely using Cisco Webex.

10.14. The STUDENT ensures full participation in distance learning with a camera and microphone via a computer or phone (built-in or peripheral devices); otherwise, attendance will not be recorded.

10.15. The STUDENT receives an invitation to the remote session at the email specified in the Agreement. The email shows the session time and link to join. If 48 hours before the start the STUDENT has not received the invitation, the STUDENT must immediately contact the DRIVING SCHOOL to resolve the issue.

10.16. The STUDENT should join on time (10–30 minutes before the start) to avoid last-minute technical problems that could hinder participation. In case of problems, the STUDENT immediately contacts the DRIVING SCHOOL administration by phone +371 28813188 and email info@presto.lv.

10.17. Before entering the virtual classroom using the link, the STUDENT enters their name, surname and email. The data must match the Agreement.

10.18. The instructor starts the session by marking attendance in the training attendance log.

10.19. If the STUDENT cannot attend the First Aid course, the STUDENT must cancel the application no later than 48h before the start; otherwise, the fee paid will not be refunded.

10.20. Persons with secondary or higher medical education or studying in the respective educational institutions are exempt from first aid courses.

10.21. After the theoretical part, the DRIVING SCHOOL sends the STUDENT information about the place and time of the practical part. The STUDENT understands that this may be delayed until the end of the state of emergency, and therefore will not raise claims against the DRIVING SCHOOL. After completing the practical part, the STUDENT will immediately be issued a certificate for completion of the first aid course.
