DRIVING TRAINING AGREEMENT No. 001 for Category “A1”

LLC “Presto Autoskola”, hereinafter referred to as the “DRIVING SCHOOL”, and , hereinafter referred to as the “STUDENT”, conclude the following agreement, hereinafter – the “Agreement”:

1. SUBJECT OF THE AGREEMENT

1.1. The DRIVING SCHOOL shall provide the STUDENT with training for the selected category in accordance with Cabinet Regulation No. 358 “Regulations on the Training of Vehicle Drivers and Driver Training Programmes” (hereinafter – the “Regulations”).

1.2. Upon conclusion of the Agreement, a profile with a Presto e-account (hereinafter – the “e‑account”) is automatically created for the STUDENT. Profile access: username – the STUDENT’s e‑mail specified in the Agreement; password – the Agreement number. After logging into the system, the STUDENT shall change the password.

2. OVERVIEW OF PAYMENT PROCEDURES

3. PAYMENT OPTIONS FOR DRIVING SCHOOL SERVICES

3.1. The STUDENT may make payment:

3.1.1. by bank payment card;

3.1.2. by bank transfer based on the Agreement, indicating the Agreement number and purpose;

3.1.3. in cash at the DRIVING SCHOOL office;

4. ADDITIONAL SERVICES

First Aid courses (if necessary)

4.1. If the STUDENT does not have a First Aid course certificate, they register and pay for the First Aid course on the DRIVING SCHOOL website (https://presto.lv/pirma-palidziba-kursi) or in person at the DRIVING SCHOOL. The course assessment takes place at the end of the 2nd lesson. Persons with secondary or higher medical education or studying in the relevant educational institutions are exempt from the First Aid course.

4.2. If the STUDENT cannot attend the First Aid course, they must cancel the application no later than 48h before the start of the course; otherwise, the amount paid for the training will not be refunded to the STUDENT.

Medical certificate (if necessary)

4.3. If the STUDENT does not have a driver’s medical certificate, then on the DRIVING SCHOOL website (https://presto.lv/mediciniska-izzina) the STUDENT selects a medical commission at one of the medical institutions by submitting an electronic application and payment (special price).

5. PRACTICAL TRAINING PROCEDURE

CSDD driving learning permit.

5.1. Before starting driving lessons, the STUDENT undertakes to obtain a driving learning permit at CSDD in person.

Procedure for organising driving instruction.

5.2. Driving instruction is organised electronically using the DRIVING SCHOOL website presto.lv.

5.3. The STUDENT tops up the profile e‑account balance for booking driving lessons in accordance with the procedure specified in Section 3.

5.4. The STUDENT selects the desired lesson time and instructor (confirming it by taking into account the price list of the respective instructor).

5.5. If the STUDENT cannot attend a driving lesson, they must cancel the driving lesson no later than 24h before the start of the lesson; otherwise, the amount paid for the driving training will not be returned to the STUDENT in the e‑account balance.

5.6. The instructor has the right to refuse the scheduled lesson up to 12h before the start of the lesson. In such a case, the money for the lesson is returned to the STUDENT in the e‑account balance. If the lesson is cancelled less than 12h before the start, the DRIVING SCHOOL compensates the lesson fee and adds EUR 20.00 to the STUDENT’s balance.

5.7. The money paid into the e‑account balance may be used only for booking driving lessons.

Conduct of driving lessons.

5.8. Before starting practical driving training, the STUDENT presents to the instructor the driving licence (CSDD driving learning permit) and the training card. It is issued by the respective driving school where the STUDENT acquires theoretical knowledge for obtaining a driving licence after listening to the theoretical training course part specified in the Regulations.

5.9. The STUDENT brings the driving training process record logbook to each lesson, which is issued to the STUDENT by the DRIVING SCHOOL (at the office or by the instructor). The instructor records the date of the lesson and what was done during the lesson.

5.10. For obtaining a driving licence, after completing the 10 minimum practical driving lessons (20 academic hours) specified in the Regulations, according to the STUDENT’s performance and readiness for the CSDD exam, the instructor verbally informs the STUDENT about the need for additional lessons or refers them to the DRIVING SCHOOL driving exam.

Driving school driving exam (to obtain a driving licence).

5.11. Taking the DRIVING SCHOOL driving exam is allowed only after passing the DRIVING SCHOOL theory exam – a note is made in the training card.

5.12. Organisation and payment of the DRIVING SCHOOL driving exam takes place like for any driving lesson by selecting “Driving exam” instead of the instructor. When it has been passed successfully, the examiner signs the driving training completion certificate by making a note in the training card.

6. RESPONSIBILITY OF THE PARTIES.

6.1. By signing the Agreement, the STUDENT confirms that they have read and agree to comply with the DRIVING SCHOOL internal rules.

6.2. The DRIVING SCHOOL has the right to unilaterally amend the Agreement by notifying about it by phone or in writing 10 days in advance.

6.3. The DRIVING SCHOOL has the right to terminate the concluded Agreement with the STUDENT without prior notice if:

6.3.1. the STUDENT makes illegal payments to the instructor for driving lessons;

6.3.2. the STUDENT has provided false information for the conclusion of the Agreement;

6.3.3. the STUDENT is aggressive during lessons or maliciously damages the DRIVING SCHOOL’s property. In such a case, the STUDENT shall pay the DRIVING SCHOOL the damages caused within 3 working days; otherwise, undertakes to additionally pay a contractual penalty in double the amount of the damages caused.

6.4. If either party terminates the Agreement before the term, the amounts paid by the STUDENT are not refunded, except in the case specified in Clause 7.2 of the Agreement, and access to the system is closed.

6.5. The STUDENT agrees and the DRIVING SCHOOL is entitled to process the STUDENT’s personal data (collection, storage, registration, entry, transfer to CSDD). The purpose of processing is student registration and the provision of services.

6.6. The Parties are not responsible for non‑performance of the obligations of the Agreement if it was caused by force majeure.

7. DISPUTE RESOLUTION PROCEDURE.

7.1. If the DRIVING SCHOOL branch administrator or instructor does not fulfil the conditions of this Agreement, the STUDENT is obliged to immediately inform the DRIVING SCHOOL management, using the phone indicated in the details.

7.2. Upon a justified claim by the STUDENT, the DRIVING SCHOOL returns the money for the corresponding part of the training process. The STUDENT must immediately submit a written claim. The DRIVING SCHOOL management reviews it within 10 working days.

7.3. An irreconcilable dispute arising from this Agreement shall be resolved in accordance with the laws of the Republic of Latvia.

8. RIGHT OF WITHDRAWAL

8.1. The STUDENT has the right to unilaterally withdraw from the Agreement within 14 days from the date of conclusion of the Agreement, if the service has not been used within these 14 days, or if a shorter period than 24h remains to cancel a driving lesson (Clause 5.5 of the Agreement). To exercise the right of withdrawal, the STUDENT must fill in a written withdrawal form available electronically on the website and submit it electronically or send it to the DRIVING SCHOOL’s legal address: Ģertrūdes iela 19/21‑4, Rīga, LV‑1011, Latvia. The withdrawal form can be downloaded HERE. To meet the withdrawal deadline, it is sufficient for the STUDENT to send their notification of exercising the right of withdrawal before the withdrawal period expires.

8.2. The right of withdrawal cannot be exercised in the following cases:

8.2.1. after the statutory term has expired, i.e. 14 days;

8.2.2. if the provision of the service has begun.

8.3. The amount of money paid for the service, when exercising the right of withdrawal, will be refunded to the STUDENT in full no later than 21 (twenty‑one) days after the DRIVING SCHOOL is informed (receives the withdrawal form) of the STUDENT’s decision to withdraw from this Agreement. The refund will be made using the same means of payment that the STUDENT used for the initial transaction, unless the STUDENT has clearly expressed consent to do otherwise.

9. OTHER PROVISIONS.

9.1. The Agreement enters into force upon signature. It is drawn up in 2 copies – one for the DRIVING SCHOOL, the other – for the STUDENT.

9.2. Term of the Agreement – 1 year, not longer than 3 years from the start date of the CSDD‑registered theory course. The STUDENT may extend the Agreement by making the payments specified in Section 2.
