TRAINING AGREEMENT No. 001 for category “C”

SIA ”Presto Autoskola”, hereinafter referred to as the “DRIVING SCHOOL”, and , hereinafter referred to as the "STUDENT", conclude the following agreement, hereinafter in the text – the agreement:

1. SUBJECT OF THE AGREEMENT

1.1. The DRIVING SCHOOL provides the STUDENT with training for the selected category in accordance with Cabinet Regulation No. 358 “Regulations on the Training of Vehicle Drivers and Vehicle Driver Training Programmes”, hereinafter - the Regulations.

1.2. Upon concluding the agreement, the STUDENT is automatically created a profile with a Presto e-account (hereinafter - e-account). Access to the profile: username - the STUDENT’S email specified in the agreement, password - the agreement number. After logging into the system, the STUDENT changes the password.

1.3. During a state-declared emergency situation, agreement Clauses No. 4.5., 4.6., 4.7., 4.8., 4.9., 4.10., 4.11., 4.12. and the subsection “First Aid Courses” of Section 4 become invalid.

2. OVERVIEW OF PAYMENT PROCEDURE

*The theory fee is subsidised. If the training is carried out only in the theory course and/or the driving training is not completed (the driving school driving exam has not been passed) during the term of the agreement, then the STUDENT pays the indicated full theory course price.

2.3. First aid course (if needed) 55.00 - 80.00 Must be paid within 14 days of concluding the agreement at the DRIVING SCHOOL or on the home page
2.4. Medical commission (if needed) 28.50 - 100.00 Must be paid within 14 days of concluding the agreement on the home page. The price depends on the selected institution (special price, the largest network)
2.5. First payment for driving lessons 200.00 Must be paid at the DRIVING SCHOOL within 14 days of concluding the agreement. It is added to the e-account balance for ordering driving lessons
2.6. Driving school theory exam 0.00

Must be passed within 20 days after the end of the theory course, otherwise the exam fee is EUR 15.00. If more than 1 mistake is made, or the booked exam is not attended, or the exam is cancelled less than 24h before it starts, the retake fee is EUR 15.00.

2.7. 1 driving lesson / 2 acad. hrs. 61.00 - 65.00 A minimum of 10 lessons is required. The price depends on the qualifications of the selected instructor and the training vehicle

3. PAYMENT OPTIONS FOR DRIVING SCHOOL SERVICES

3.1. The STUDENT may make payment:

3.1.1. by bank payment card;

3.1.2. by bank transfer based on the agreement, indicating the agreement number and purpose;

3.1.3. in cash at the DRIVING SCHOOL’S office;

4. PROCEDURE FOR THEORETICAL TRAINING

4.1. Lessons will take place at – X, ....

4.2. Language of instruction - Latviešu.

4.3. In accordance with the Regulations, the group start date may be postponed if there is not the minimum number of persons required to commence training. The DRIVING SCHOOL informs the STUDENT of the exact start date of the lessons.

4.4. If the lessons do not start within 45 days from the moment the agreement is signed, the STUDENT has the right to request a refund of the money paid, with or without termination of the agreement.

Absences from theory lessons

4.5. A theory lesson is considered attended if the STUDENT has attended all the scheduled study hours on the training day.

4.6. The STUDENT applies electronically for making up missed theory lessons using the DRIVING SCHOOL’S home page presto.lv, selecting the desired branch for make-up, day and time. Lesson registration in CSDD is carried out within 3 working days, after which the STUDENT receives a confirmation email. After receiving the email, the STUDENT is allowed to attend the booked theory lesson.

4.7. If the STUDENT cannot attend the booked make-up lesson for a missed theory lesson, the STUDENT is obliged to cancel the booking no later than 48h before the start of the lesson, otherwise the money paid for the lesson is not refunded to the STUDENT.

Driving school theory exam.

4.8. The organisation of the DRIVING SCHOOL’S theory exam takes place electronically using the DRIVING SCHOOL’S home page presto.lv.

4.9. The STUDENT is admitted to the theory exam on condition that all obligations towards the DRIVING SCHOOL have been settled, and there is a valid medical certificate and first aid certificate.

4.10. The driving school theory exam may be taken once per day. It consists of 35 questions. The STUDENT may make 1 mistake; otherwise, the exam must be retaken.

4.11. Upon arrival at the driving school theory exam, the STUDENT presents an identity document; otherwise, the STUDENT is not admitted to it.

4.12. If the STUDENT cannot attend the theory exam, the STUDENT is obliged to cancel it no later than 24h before the start of the exam, otherwise the money paid for the exam is not refunded to the STUDENT’S e-account balance.

4.13. The DRIVING SCHOOL enters the data into the CSDD database within 2 working days, after which taking the theory exam at CSDD becomes available, and the STUDENT receives an informational email about it.

Online exam administration

4.14. The organisation of the DRIVING SCHOOL’S theory exam takes place electronically using the DRIVING SCHOOL’S home page presto.lv. Taking the exam in person at the Riga Central District branch may take place only in exceptional cases by booking it by phone at +371 28813188 or by email: info@presto.lv.

4.15. The STUDENT is admitted to the theory exam on condition that all obligations towards the DRIVING SCHOOL have been settled, and there is a valid medical certificate and first aid certificate.

4.16. The driving school theory exam may be taken once per day. It consists of 35 questions. The STUDENT may make 1 mistake; otherwise, the exam must be retaken.

4.17. For remote exam taking, the Cisco Webex video presentation tool is used on the phone to provide a camera, and the Any Desk computer program is used to perform the exam remotely on the driving school’s computer. Therefore, both a phone and a computer will be required simultaneously.

4.18. The student is invited to a remote exam via the email specified in the agreement. In the email, the student sees the lesson time and the link to enter it. The STUDENT is prohibited from sharing the link with unauthorised persons.

4.19. Before entering the exam virtual room using the given link, the student is asked to indicate their first name, surname, and email address once again. The student indicates their real first name, surname, and the email specified in the agreement.

4.20. After entering the exam virtual room, the STUDENT places the phone against the computer monitor or computer so that the STUDENT is clearly visible to the examiner from the front and it does not interfere with taking the exam. During the exam, the STUDENT is prohibited from taking their eyes off the monitor, turning around, leaving the exam place, talking to other persons except the examiner, as well as carrying out any actions not related to taking the exam. At the examiner’s request, the STUDENT shows the room in which they are located so that the examiner can verify the fairness of the exam.

4.21. The STUDENT shows the examiner a passport or identity card. The examiner verifies the STUDENT’S readiness to start the exam.

4.22. The examiner asks the STUDENTS to launch the Any Desk program. The examiner gives each examinee a connection number code in online chat format, which must be entered into the Any Desk program. Shortly afterwards, the connection will be confirmed and the STUDENT will begin taking the exam on the CSDD home page in the corresponding category.

4.23. The STUDENT ensures full participation in the online theory exam with the ability to provide camera and microphone functionality, the necessary software already downloaded, as well as sufficient internet capacity. Otherwise, the examiner may refuse to administer the online theory exam.

4.24. If all the above-mentioned agreement clauses of the section ‘’Online exam administration’’ are not observed, the examiner may interrupt the exam by informing the STUDENT and stating the reason (first time - warning, second time - disqualification from the exam), as a result of which the exam will not be counted and it must be retaken by registering for it in the agreement-prescribed procedure as for a repeated exam.

4.25. After the exam, the DRIVING SCHOOL representative informs the STUDENT of the exam result.

4.26. If the STUDENT cannot participate in the theory exam, the STUDENT is obliged to cancel it no later than 24h before the start of the exam, otherwise the money paid for the exam is not refunded to the STUDENT’S e-account balance.

4.27. The DRIVING SCHOOL enters the data into the CSDD database within 5 working days, after which taking the theory exam at CSDD becomes available, and the STUDENT receives an informational email about it.

4.28. A video recording is made for exam control purposes. By this, the STUDENT confirms consent to its making. The video recording is stored for no longer than 1 (one) month.

CSDD theory exam.

4.29. After receiving the informational email, the STUDENT takes the CSDD theory exam within 3 working days, or retakes the driving school exam 3 working days before the planned CSDD exam.

First aid courses (if necessary)

4.30. If the STUDENT does not have a first aid course certificate, the STUDENT applies for and pays for first aid courses on the DRIVING SCHOOL’S home page (https://presto.lv/en/first-aid-training) or in person at the DRIVING SCHOOL. The course assessment takes place at the end of the 2nd lesson. Persons who have secondary or higher medical education or who are studying at the relevant educational institutions are exempt from first aid courses.

4.31. If the STUDENT cannot attend the first aid course, the STUDENT is obliged to cancel the application no later than 48h before the start of the course, otherwise the money paid for the training is not refunded to the STUDENT.

Medical certificate (if necessary)

4.32. If the STUDENT does not have a driver’s medical certificate, then on the DRIVING SCHOOL’S home page (https://presto.lv/en/medical-certificate) the STUDENT selects a medical commission in one of the medical institutions, making an electronic application and payment (special price).

5. PROCEDURE FOR PRACTICAL TRAINING

Procedure for organising driving training.

5.1. The organisation of driving training takes place electronically using the DRIVING SCHOOL’S home page presto.lv.

5.2. In accordance with the procedure of Section 2 of the agreement, the STUDENT’S e-account balance is topped up by EUR 200.00 after receipt of payment for ordering driving lessons. Additional payments are made in accordance with the procedure set out in Section 3.

5.3. The STUDENT chooses the desired lesson time and instructor (taking into account the price list of the relevant instructor, confirms it).

5.4. If the STUDENT cannot attend a driving lesson, the STUDENT is obliged to cancel the driving lesson no later than 24h before the start of the lesson, otherwise the money paid for driving training is not refunded to the STUDENT’S e-account balance.

5.5 The instructor has the right to cancel the booked lesson 12h before the start of the lesson. In such a case, the money for the lesson is refunded to the STUDENT’S e-account balance. If the lesson is cancelled less than 12h before it starts, the DRIVING SCHOOL compensates the lesson fee and tops up the STUDENT’S balance by EUR 20.00.

Conduct of driving lessons.

5.6. Before starting practical driving training, the STUDENT presents the CSDD driving licence and the driving training process log to the instructor.

5.7. The STUDENT brings the driving training process log to each lesson, which is issued to the STUDENT by the DRIVING SCHOOL (in the office or by the instructor). The instructor makes an entry regarding the date of the lesson and what was accomplished during the lesson.

5.8. After completing the 10 minimum practical driving lessons (20 acad. hrs.) laid down in the Regulations, in accordance with the STUDENT’S performance and readiness for the CSDD exam, the instructor verbally informs the STUDENT of the need for additional lessons or sends the STUDENT to the DRIVING SCHOOL’S driving exam.

5.9. Taking the DRIVING SCHOOL’S driving exam is allowed only after the DRIVING SCHOOL’S theory exam has been passed – a mark has been made in the presto.lv profile.

5.10. The organisation and payment of the DRIVING SCHOOL’S driving exam take place as for any driving lesson, by choosing a driving instructor with whom no training has previously taken place. Otherwise, it is counted as a regular driving lesson, and the instructor has no right to make a mark regarding completion of driving training.

5.11. Upon arriving for the lesson, the student informs the instructor that instead of the lesson they wish to take the exam. Once it has been successfully passed, the examiner fills in a protocol in the presto.lv profile, which is the certificate of completion of driving training.

5.12. After taking the exam, the protocol is available in the student’s profile section "Dokumenti". The exam results may be contested within 5 days by submitting a complaint to the driving school in the form of an application.

5.13. After the exam has been passed, the data are entered into the CSDD database within 5 working days. This allows the STUDENT to take the CSDD practical exam, about which the STUDENT receives an informational email.

6. DISTANCE LEARNING

6.1. Procedure for video-based theoretical training.

6.1.1. Theory courses take place remotely using the macam.lv platform.

6.1.2. The STUDENT ensures sufficient internet capacity (min. 20 Mbps) and a stable internet connection.

6.1.3. The STUDENT is registered in a video training group within one week from the moment of application, after which the STUDENT receives an email invitation to join the video training platform and its user instructions. The first login to the system must be made no later than within 5 days from the moment of receiving the email, otherwise the user will be blocked (contact the administration).

6.1.4. The duration of the theoretical training course is from 4 weeks to 1 year and consists of 10 lessons (modules). The duration of each module is 5 academic hours. It is permitted to attend 1 module per day, but 3 modules per week. The theory course is considered completed when all theory lessons have been attended, the test after each module has been passed, and the DRIVING SCHOOL’S theory exam has been passed.

6.1.5. The STUDENT watches 6 theory lessons in the video training. They may be viewed at a freely chosen time and pace from Monday to Sunday, except from 23:55-00:05 (the system performed data synchronisation with CSDD, therefore attendance will not be saved).

6.1.6. At the end of each video lecture, a test must be taken, consisting of 10 questions with one permissible mistake. The test may be taken 3 times. If the test is not passed, the relevant lesson is not counted and must be studied again. In the video training environment, attendance is counted on the day when the lesson test is passed.

6.1.7. The STUDENT attends 4 theory lessons in person. The duration of each module is 5 academic hours. A lesson is considered attended if the STUDENT has attended and completed all the scheduled study hours on the training day.

6.1.8. The STUDENT applies electronically for in-person theory lessons starting from the 15th training day, using the DRIVING SCHOOL’S home page presto.lv, selecting the desired branch, day and time.

6.1.9. Lesson registration in CSDD is carried out within 3 working days, after which the STUDENT receives a confirmation email. Only after receiving the email is the STUDENT allowed to attend the booked theory lesson.

6.2. PROCEDURE FOR ONLINE THEORETICAL TRAINING

6.2.1. Theory courses take place remotely using the Cisco Webex video presentation tool.

6.2.2. The STUDENT ensures full participation in distance learning with camera and microphone capability provided by the main or additional (peripheral) devices or functionality of a computer or phone, as well as sufficient internet capacity, otherwise attendance will not be counted.

6.2.3. The link to each lesson will be available in the STUDENT’S profile section "Teorijas grafiks" next to the date of each lesson. The lesson link is not sent by email!

We remind you that familiarising yourself with the presto.lv profile in due time will make it easier to connect before the lesson starts, so that it is successful and does not cause unnecessary stress.

6.2.4. The STUDENT tries to arrive for the lesson on time (10-30 min. before it starts) in order to avoid last-minute technical problems that could interfere with full participation in the lesson. In case of problems, the STUDENT immediately contacts the driving school administration by phone at +371 28813188 and email info@presto.lv.

6.2.5. Before entering the virtual training room using the received link, the STUDENT indicates their first name, surname and email address. The indicated data must match those specified in the agreement.

6.2.6. The instructor begins the lesson by marking the STUDENT’S attendance in the driving school and CSDD lesson attendance journal.

6.2.7. A video recording is made for lesson control purposes. By this, the STUDENT confirms consent to its making. The video recording is stored for no longer than 1 (one) month.

6.2.8. Theoretical lessons are conducted remotely during a state-declared emergency situation. After the emergency situation ends, theoretical training will be carried out in person at the selected driving school branch.

6.2.9. The STUDENT is prohibited from sharing information that allows a third party to participate in distance learning.

Absences from theory lessons

6.3. For each lesson, the driving school has access to data generated by the video presentation tool on each STUDENT’S participation in the lesson - day, arrival time, end time, participation duration in minutes. If the DRIVING SCHOOL establishes that the STUDENT has interrupted attendance for a period longer than 10 minutes, a mark "Left" is made in the driving school and CSDD attendance journal. A theory lesson is considered attended if the STUDENT has attended and completed all the scheduled study hours on the training day.

6.4. The STUDENT applies electronically for making up missed theory lessons using the DRIVING SCHOOL’S home page presto.lv, selecting the desired make-up branch, day and time. Lesson registration in CSDD is carried out within 2 working days, after which the STUDENT receives a confirmation email. After receiving the email, the STUDENT is allowed to attend the booked theory lesson.

6.5. If the STUDENT cannot attend the booked theory lesson (first attendance of the video training STUDENT, make-up of a missed theory lesson, or rebooked make-up of a theory lesson if attendance has not been completed), the STUDENT is obliged to cancel the booking no later than 48h before the start of the lesson, otherwise the money paid for the lesson is not refunded to the STUDENT.

7. LIABILITY OF THE PARTIES

7.1. By signing the agreement, the STUDENT confirms that they have ознакомился and agrees to comply with the internal regulations of the DRIVING SCHOOL.

7.2. The DRIVING SCHOOL has the right to amend the Agreement unilaterally by notifying about this by phone, in writing, or during theory lessons 10 days in advance.

7.3. The DRIVING SCHOOL has the right to terminate the concluded agreement with the STUDENT without prior notice if:

7.3.1. The STUDENT does not comply with the payment procedure;

7.3.2. The STUDENT makes unlawful payments to the instructor for conducting driving lessons;

7.3.3. The STUDENT has provided false information for concluding the agreement;

7.3.4. The STUDENT is aggressive during lessons or maliciously damages the property of the DRIVING SCHOOL. In such a case, the STUDENT shall compensate the losses caused to the DRIVING SCHOOL within 3 working days; otherwise, the STUDENT undertakes additionally to pay a contractual penalty in double the amount of the value of the losses caused.

7.4. If either party terminates the agreement before its expiry, the money paid by the STUDENT is not refunded, except in the case provided for in Clause 8.2. of the Agreement, and access to the system is closed.

7.5. The STUDENT agrees and the DRIVING SCHOOL is entitled to process the STUDENT’S personal data (collection, storage, registration, entry, transfer to CSDD). The purpose of data processing is the registration of STUDENTS and the provision of services.

7.6. The parties are not liable for non-performance of the contractual obligations if caused by force majeure.

8. DISPUTE RESOLUTION PROCEDURE

8.1. If the branch administrator or instructor of the DRIVING SCHOOL does not comply with the terms of this agreement, the STUDENT has the duty to inform the management of the DRIVING SCHOOL immediately by using the phone number indicated in the particulars.

8.2. On the basis of a justified complaint from the STUDENT, the DRIVING SCHOOL shall refund the money for the relevant part of the training process. The STUDENT is obliged to submit a written complaint immediately. The management of the DRIVING SCHOOL shall review it within 10 working days.

8.3. Any irreconcilable dispute arising from this agreement shall be resolved in accordance with the procedure laid down by the laws and regulations of the Republic of Latvia.

9. OTHER PROVISIONS

9.1. The agreement enters into force at the moment of its signing. It is drawn up in 2 copies - one for the DRIVING SCHOOL, the other for the STUDENT.

9.2. The term of the agreement is 3 years.

9.3. The agreement is terminated if the STUDENT does not pass the DRIVING SCHOOL’S theory exam within 1 year from registration in the CSDD training group or does not obtain a driving licence within 3 years (the CSDD driving exam has not been passed).

9.4. In both cases referred to in Clause 9.3., a new training agreement is concluded for the full scope of training.
