SIA "Presto Autoskola", hereinafter referred to as the "DRIVING SCHOOL", and , hereinafter referred to as the "STUDENT", enter into this Agreement, hereinafter referred to as the Agreement:
1.1. The DRIVING SCHOOL provides the STUDENT with training for the selected category in accordance with Cabinet of Ministers Regulation No. 358 "Regulations on the Training of Vehicle Drivers and Vehicle Driver Training Programmes", hereinafter referred to as the Regulations.
1.2. Upon conclusion of the Agreement, a profile with a Presto e-konts (hereinafter - e-account) is automatically created for the STUDENT. Access to the profile: username - the STUDENT'S email address specified in the Agreement, password - the Agreement number. After logging into the system, the STUDENT changes the password.
1.3. During a state-declared emergency situation, Clauses 4.5., 4.6., 4.7., 4.8., 4.9., 4.10., 4.11., 4.12. of the Agreement and the subsection "First Aid Courses" of Section 4 shall cease to be in force.

3.1. The STUDENT may make payment:
3.1.1. by bank payment card;
3.1.2. by bank transfer on the basis of the Agreement, indicating the Agreement number and purpose of payment;
3.1.3. in cash at the DRIVING SCHOOL'S office;
4.1. The lessons shall take place at – X, ....
4.2. The language of instruction - Latviešu.
4.3. In accordance with the Regulations, the start date of the group may be postponed if the minimum required number of persons for the commencement of training is not reached. The DRIVING SCHOOL shall inform the STUDENT of the exact start date of the lessons.
4.4. If the lessons do not commence within 45 days from the signing of the Agreement, the STUDENT shall have the right to request a refund of the money paid, with or without termination of the Agreement.
4.5. A theory lesson shall be deemed attended if the STUDENT has attended all of the prescribed training hours on the training day.
4.6. The STUDENT registers electronically for the make-up of missed theory lessons using the DRIVING SCHOOL'S website presto.lv, selecting the preferred branch for the make-up, day and time. The lesson is registered with CSDD within 3 working days, after which the STUDENT receives a confirmation email. After receipt of the email, the STUDENT is permitted to attend the registered theory lesson.
4.7. If the STUDENT is unable to attend the registered make-up lesson for the missed theory lesson, the STUDENT must cancel the registration no later than 48 hours before the beginning of the lesson; otherwise, the fee paid for the lesson shall not be refunded to the STUDENT.
4.8. If the STUDENT does not have a first aid course certificate, the STUDENT registers for and pays for the first aid courses on the DRIVING SCHOOL'S website (https://presto.lv/pirma-palidziba-kursi) or in person at the DRIVING SCHOOL. The course assessment takes place at the end of the 2nd lesson. Persons with secondary or higher medical education, or persons studying at the relevant educational institutions, are exempt from first aid courses.
4.9. If the STUDENT is unable to attend the first aid course, the STUDENT must cancel the registration no later than 48 hours before the beginning of the course; otherwise, the fee paid for the training shall not be refunded to the STUDENT.
4.10. If the STUDENT does not have a driver's medical certificate, then on the DRIVING SCHOOL'S website (https://presto.lv/mediciniska-izzina) the STUDENT selects a medical commission at one of the medical institutions by making an electronic application and payment (special price).
5.1. Driving training is organised electronically using the DRIVING SCHOOL'S website presto.lv.
5.2. In accordance with the procedure set out in Section 2 of the Agreement, upon receipt of the payment, the STUDENT'S e-account balance is credited with EUR 116.00 for booking driving lessons. Additional payments shall be made in accordance with the procedure set out in Section 3.
5.3. The STUDENT selects the desired lesson time and instructor (taking into account the respective instructor's price list and confirms it).
5.4. If the STUDENT is unable to attend a driving lesson, the STUDENT must cancel the driving lesson no later than 24 hours before the beginning of the lesson; otherwise, the fee paid for the driving training shall not be refunded to the STUDENT'S e-account balance.
5.5. The instructor has the right to cancel the booked lesson 12 hours before the beginning of the lesson. In such case, the money for the lesson shall be refunded to the STUDENT'S e-account balance. If the lesson is cancelled less than 12 hours before the beginning of the lesson, the DRIVING SCHOOL shall compensate the lesson fee and credit the STUDENT'S balance with EUR 20.00.
5.6. Before commencing practical driving training, the STUDENT presents the CSDD driving licence and the driving training process logbook to the instructor.
5.7. The STUDENT brings the driving training process logbook to each lesson; this logbook is issued to the STUDENT by the DRIVING SCHOOL (at the office or by the instructor). The instructor records the date of the lesson and what was accomplished during the lesson.
5.8. After completion of the 4 minimum practical driving lessons (8 academic hours) specified in the Regulations, depending on the STUDENT'S performance and readiness for the CSDD examination, the instructor orally informs the STUDENT of the need for additional lessons or sends the STUDENT to the DRIVING SCHOOL'S driving examination.
5.9. Taking the DRIVING SCHOOL'S driving examination is permitted only after completion of the DRIVING SCHOOL'S theory course – a corresponding mark has been made in the presto.lv profile.
5.10. The organisation and payment of the DRIVING SCHOOL'S driving examination take place in the same manner as for any driving lesson by selecting a driving instructor with whom the STUDENT has not trained before. Otherwise, it shall be counted as an ordinary driving lesson, and the instructor shall not be entitled to make a mark on the completion of driving training.
5.11. Upon arriving for the lesson, the Student informs the instructor that instead of the lesson, the Student wishes to take the examination. Once it has been successfully passed, the examiner fills in a protocol in the presto.lv profile, which serves as confirmation of completion of driving training.
5.12. After the examination, the protocol is available in the Student's profile section "Documents". The examination results may be contested within 5 days by submitting a written complaint to the driving school.
5.13. After the examination has been passed, the data are entered into the CSDD database within 5 working days. This allows the STUDENT to take the CSDD practical examination, of which the STUDENT receives an informational email.
6.1. Theory courses take place remotely using the Cisco Webex video presentation tool.
6.2. The STUDENT ensures full participation in distance learning with camera and microphone capability provided by the basic or additional (peripheral) equipment or functionality of a computer or telephone, as well as sufficient internet capacity, otherwise attendance shall not be counted.
6.3. A link to each lesson shall be available in the STUDENT'S profile section "Theory schedule" next to the date of each lesson. The lesson link is not sent by email!
We remind you that familiarising yourself with the presto.lv profile in a timely manner will make it easier to connect before the beginning of the lesson so that it is successful and does not create unnecessary stress.
6.4. The STUDENT tries to join the lesson on time (10-30 min. before its beginning) in order to avoid last-minute technical problems that could prevent full participation in the lesson. In case of problems, the STUDENT shall immediately contact the driving school administration using telephone nr. +371 28813188 and email info@presto.lv.
6.5. Before entering the virtual training room using the received link, the STUDENT indicates the first name, surname and email address. The indicated data must match those specified in the Agreement.
6.6. The instructor begins the lesson by marking the STUDENT'S attendance in the driving school's and CSDD's lesson attendance register.
6.7. A video recording is made for lesson monitoring purposes. By this, the STUDENT confirms consent to such recording. The video recording shall be stored for no longer than 1 (one) month.
6.8. Theoretical training is conducted remotely during a state-declared emergency situation. Once the emergency situation ends, theoretical training shall take place in person at the selected branch of the driving school.
6.9. The STUDENT is prohibited from sharing information that allows a third person to participate in distance learning.
6.10. For each lesson, the driving school has access to data generated by the video presentation tool regarding each STUDENT'S participation in the lesson - day, arrival time, finishing time, duration of participation in minutes. If the DRIVING SCHOOL establishes that the STUDENT has interrupted attendance for a period exceeding 10 minutes, a note "Devies prom" is made in the driving school's and CSDD's lesson attendance register. A theory lesson shall be deemed attended if the STUDENT has attended and listened to all prescribed training hours on the training day.
6.11. The STUDENT registers electronically for the make-up of missed theory lessons using the DRIVING SCHOOL'S website presto.lv, selecting the preferred branch for the make-up, day and time. The lesson is registered with CSDD within 2 working days, after which the STUDENT receives a confirmation email. After receipt of the email, the STUDENT is permitted to attend the registered theory lesson.
6.12. If the STUDENT is unable to attend the registered make-up lesson for the missed theory lesson, the STUDENT must cancel the registration no later than 48 hours before the beginning of the lesson; otherwise, the fee paid for the lesson shall not be refunded to the STUDENT.
6.13. The DRIVING SCHOOL'S theory examination is organised electronically using the DRIVING SCHOOL'S website presto.lv. Taking the examination in person at the Riga Central District branch may take place only by way of exception by registering by telephone nr. +371 28813188 or by email: info@presto.lv.
6.14. The STUDENT is admitted to the theory examination provided that all obligations towards the DRIVING SCHOOL have been fulfilled and a valid medical certificate and first aid certificate are available.
6.15. The driving school's theory examination may be taken once per day. It consists of 30 questions. The STUDENT may make 1 mistake; otherwise, the examination must be retaken.
6.16. For taking the examination remotely, the Cisco Webex video presentation tool is used on the telephone to provide the camera, and the Any Desk computer program is used for remote completion of the examination on the driving school's computer. Therefore, both a telephone and a computer will be required simultaneously.
6.17. The Student is invited to the remote examination via the email specified in the Agreement. In the email, the Student sees the lesson time and the link to enter it. The STUDENT is prohibited from sharing the link with unauthorised persons.
6.18. Before entering the virtual examination room using the provided link, the Student is asked to indicate the first name, surname and email again. The Student indicates the true first name, surname and the email specified in the Agreement.
6.19. After entering the virtual examination room, the STUDENT places the telephone against the computer monitor or computer so that the STUDENT is clearly visible to the examiner from the front and it does not interfere with taking the examination. During the examination, the STUDENT is prohibited from taking their eyes off the monitor, turning around, leaving/abandoning the examination place, talking to other persons except the examiner, and performing any actions not related to taking the examination. At the examiner's request, the STUDENT shows the room in which they are located so that the examiner can verify the fairness of the examination.
6.20. The STUDENT presents a passport or identity document to the examiner. The examiner verifies the STUDENT'S readiness to begin the examination.
6.21. The examiner asks the STUDENTS to start the Any Desk program. The examiner gives each examinee a connection digit code via online chat, which must be entered into the Any Desk program. Shortly afterwards, the connection will be confirmed, and the STUDENT will begin taking the examination on the CSDD website in the relevant category.
6.22. In the event of non-compliance with all of the above-mentioned clauses of the Agreement in the section "Conduct of the online examination", the examiner may interrupt the examination, informing the STUDENT thereof and stating the reason (first time - warning, second time - disqualification from the examination), as a result of which the examination shall not be counted and must be retaken by registering for it in the manner laid down in the Agreement as a repeat examination.
6.23. After the examination, the DRIVING SCHOOL'S representative informs the STUDENT of the result of the examination.
6.24. If the STUDENT is unable to participate in the theory examination, the STUDENT must cancel it no later than 24 hours before the beginning of the examination; otherwise, the fee paid for the examination shall not be refunded to the STUDENT'S e-account balance.
6.25. The DRIVING SCHOOL prepares the training card and enters these data into the CSDD database within 5 working days, after which taking the theory examination at CSDD becomes available, and the STUDENT receives an informational email about it.
6.26. A video recording is made for examination monitoring purposes. By this, the STUDENT confirms consent to such recording. The video recording shall be stored for no longer than 1 (one) month.
6.27. If the STUDENT does not have a first aid course certificate, the STUDENT registers for and pays for the first aid courses on the DRIVING SCHOOL'S website (https://presto.lv/pirma-palidziba-kursi). Theory courses take place remotely using the Cisco Webex video presentation tool.
6.28. The STUDENT ensures full participation in distance learning with camera and microphone capability provided by the basic or additional (peripheral) equipment or functionality of a computer or telephone; otherwise, attendance shall not be counted.
6.29. The STUDENT receives an invitation to the remote lesson via the email specified in the Agreement. In the email, the Student sees the lesson time and the link to enter it. If the STUDENT has not received an email invitation 48 hours before the beginning of the lesson, the STUDENT must immediately contact the DRIVING SCHOOL to resolve the issue.
6.30. The STUDENT tries to join the lesson on time (10-30 min. before its beginning) in order to avoid last-minute technical problems that could prevent full participation in the lesson. In case of problems, the STUDENT shall immediately contact the driving school administration using telephone nr. +371 28813188 and email info@presto.lv.

6.33. If the STUDENT is unable to attend the first aid course, the STUDENT must cancel the registration no later than 48 hours before the beginning of the course; otherwise, the fee paid for the training shall not be refunded to the STUDENT.
6.34. Persons with secondary or higher medical education, or persons studying at the relevant educational institutions, are exempt from first aid courses.
6.35. After completion of the theoretical part, the driving school sends the STUDENT information on the place and time of the practical part. The STUDENT acknowledges that this may be delayed until the end of the emergency situation and, accordingly, shall not raise any claims against the driving school. After completion of the practical part, the STUDENT shall be issued a certificate of completion of the PMP course without delay.
7.1. The DRIVING SCHOOL prepares and stores the STUDENT'S training card after completion of the DRIVING SCHOOL'S theory course. The training card is issued to the STUDENT if necessary (by completing an application electronically in the profile).
7.2. By signing the Agreement, the STUDENT confirms that they have familiarised themselves with and agree to comply with the DRIVING SCHOOL'S internal rules.
7.3. The DRIVING SCHOOL has the right to amend the Agreement unilaterally by notifying thereof by telephone, in writing, or during theory lessons 10 days in advance.
7.4. The DRIVING SCHOOL has the right to terminate the concluded Agreement with the STUDENT without prior warning if:
7.4.1. the STUDENT fails to comply with the payment procedure;
7.4.2. the STUDENT makes unlawful payments to the instructor for the provision of driving lessons;
7.4.3. the STUDENT has provided false information for the conclusion of the Agreement;
7.4.4. the STUDENT behaves aggressively during lessons or wilfully damages the DRIVING SCHOOL'S property. In such case, the STUDENT shall compensate the losses caused to the DRIVING SCHOOL within 3 working days; otherwise, the STUDENT undertakes additionally to pay a contractual penalty in double the value of the losses caused.
7.5. If either party terminates the Agreement before its expiry, the money paid by the STUDENT shall not be refunded, except in the case specified in Clause 8.2. of the Agreement, and access to the system shall be closed.
7.6. The STUDENT agrees, and the DRIVING SCHOOL is entitled, to process the STUDENT'S personal data (collection, storage, registration, entry, transfer to CSDD). The purpose of data processing is the registration of STUDENTS and the provision of services.
7.7. The parties shall not be liable for non-performance of the obligations under the Agreement if caused by force majeure.
8.1. If the DRIVING SCHOOL'S branch administrator or instructor fails to comply with the terms of this Agreement, the STUDENT must immediately inform the management of the DRIVING SCHOOL using the telephone number indicated in the details.
8.2. On the basis of a justified complaint by the STUDENT, the DRIVING SCHOOL refunds money for the relevant part of the training process. The STUDENT must immediately submit a written complaint. The management of the DRIVING SCHOOL shall examine it within 10 working days.
8.3. Any irreconcilable dispute arising from this Agreement shall be resolved in accordance with the procedures provided for by the laws and regulations of the Republic of Latvia.
9.1. The Agreement enters into force upon signing thereof. It is drawn up in 2 copies - one for the DRIVING SCHOOL and one for the STUDENT.
9.2. The term of the Agreement – 3 years.
9.3. The Agreement shall be terminated if the STUDENT does not pass the DRIVING SCHOOL'S theory examination within 1 year from registration in the CSDD training group or does not obtain a driving licence within 3 years (the CSDD driving examination has been passed).
9.4. In both cases referred to in Clause 8.3., a new training agreement is concluded for the full scope of training.
