SIA "Presto Autoskola", hereinafter referred to as the "DRIVING SCHOOL", and , hereinafter referred to as the "STUDENT", conclude the following agreement, hereinafter referred to as the Agreement:
1.1. The DRIVING SCHOOL provides the STUDENT with training for the selected category in accordance with Cabinet Regulation No. 358 "Regulations Regarding the Training of Drivers of Vehicles and Driver Training Programmes", hereinafter referred to as the Regulations.
1.2. Upon conclusion of the Agreement, a profile with a Presto e-konts (hereinafter - e-account) is automatically created for the STUDENT. Access to the profile: username - the STUDENT'S email address specified in the Agreement, password - the Agreement number. After logging into the system, the STUDENT changes the password.
1.3. During a state-declared emergency situation, Clauses 4.5, 4.6, 4.7, 4.8, 4.9, 4.10, 4.11, 4.12 of the Agreement and the subsection First Aid Courses of Section 4 shall cease to apply.

3.1. The STUDENT may make payment:
3.1.1. by bank payment card;
3.1.2. by bank transfer on the basis of the Agreement, indicating the Agreement number and purpose of payment;
3.1.3. in cash at the DRIVING SCHOOL'S office;
4.1. Classes will take place at – X, ....
4.2. Language of instruction - Latviešu.
4.3. In accordance with the Regulations, the group's start date may be postponed if there is not the minimum number of persons required to commence training. The DRIVING SCHOOL informs the STUDENT of the exact start date of the classes.
4.4. If classes do not commence within 45 days from the moment of signing the Agreement, the STUDENT has the right to request a refund of the money paid, with or without termination of the Agreement.
4.5. The STUDENT agrees with the DRIVING SCHOOL on the number of additional lessons, the schedule of examinations (if such examinations must be taken), and the payment procedure, by submitting supporting documents justifying the absence.
4.6. The STUDENT registers electronically for the make-up of missed theory classes using the DRIVING SCHOOL'S website presto.lv, choosing the desired branch for the make-up, day and time. Registration of the class in CSDD is carried out within 3 working days, after which the STUDENT receives a confirmation email. After receiving the email, the STUDENT is permitted to attend the scheduled theory class.
4.7. If the STUDENT cannot attend the scheduled make-up of the missed theory class, the STUDENT is obliged to cancel the booking no later than 48h before the start of the class, otherwise the money paid for the class is not refunded to the STUDENT.
4.8. Organisation of the DRIVING SCHOOL'S theory examination takes place electronically, using the DRIVING SCHOOL'S website presto.lv.
4.9. The STUDENT is admitted to the theory examination on condition that all obligations towards the DRIVING SCHOOL have been fulfilled, and that the medical certificate and the first aid certificate are valid.
4.10. The driving school theory examination may be taken once per day. It consists of 30 questions. The STUDENT may make 1 mistake; otherwise, the examination must be retaken.
4.11. Upon arriving for the driving school theory examination, the STUDENT presents an identity document; otherwise, the STUDENT is not admitted to the examination.
4.12. If the STUDENT cannot attend the theory examination, the STUDENT is obliged to cancel it no later than 24h before the start of the examination, otherwise the money paid for the examination is not refunded to the STUDENT'S e-account balance.
4.13. The DRIVING SCHOOL prepares the training card and enters these data into the CSDD database within 2 working days, after which taking the theory examination at CSDD becomes available, about which the STUDENT receives an informational email.
4.14. Within 3 working days after passing the driving school theory examination, the STUDENT must take the theory examination at CSDD, or retake the driving school examination 3 working days before the planned CSDD examination.
4.15. If the STUDENT does not have a first aid course certificate, the STUDENT registers for and pays for the first aid courses on the DRIVING SCHOOL'S website (https://presto.lv/pirma-palidziba-kursi) or in person at the DRIVING SCHOOL. The pass mark for the course is awarded at the end of the 2nd class. Persons who have secondary or higher medical education or who are studying at the relevant educational institutions are exempt from first aid courses.
4.16. If the STUDENT cannot attend the first aid course, the STUDENT is obliged to cancel the booking no later than 48h before the start of the course, otherwise the money paid for the training is not refunded to the STUDENT.
4.17. If the STUDENT does not have a driver's medical certificate, then on the DRIVING SCHOOL'S website (https://presto.lv/mediciniska-izzina) the STUDENT chooses a medical commission at one of the medical institutions by making an electronic booking and payment (special price).
5.1. Before starting driving lessons, the STUDENT undertakes to obtain a driving instruction permit from CSDD in person.
5.2. Organisation of driving training takes place electronically, using the DRIVING SCHOOL'S website presto.lv.
5.3. In accordance with the procedure set out in Section 2 of the Agreement, once the payment has been received, the STUDENT'S e-account balance is topped up by EUR 125.00 for ordering driving lessons. Additional payments are made in accordance with the procedure set out in Section 3.
5.4. The STUDENT selects the desired lesson time and instructor (taking into account the price list of the relevant instructor and confirming it).
5.5. If the STUDENT cannot attend a driving lesson, the STUDENT is obliged to cancel the driving lesson no later than 24h before the start of the lesson, otherwise the money paid for the driving training is not refunded to the STUDENT'S e-account balance.
5.6. The instructor has the right to cancel the scheduled lesson 12h before the start of the lesson. In such a case, the money for the lesson is refunded to the STUDENT'S e-account balance. If the lesson is cancelled less than 12h in advance, the DRIVING SCHOOL compensates the lesson fee and tops up the STUDENT'S balance by EUR 20.00.
5.7. Before starting practical driving training, the STUDENT presents the CSDD driving instruction permit and the driving training process record journal to the instructor.
5.8. The STUDENT brings the driving training process record journal to each lesson, which is issued to the STUDENT by the DRIVING SCHOOL (at the office or by the instructor). The instructor makes an entry regarding the date of the lesson and what was completed during the lesson.
5.9. After completion of the 10 minimum practical driving lessons (20 academic hours) stipulated in the Regulations, and depending on the STUDENT'S performance and readiness for the CSDD examination, the instructor verbally informs the STUDENT of the need for additional lessons or sends the STUDENT to the DRIVING SCHOOL'S driving examination.
5.10. Taking the DRIVING SCHOOL'S driving examination is permitted only after the DRIVING SCHOOL'S theory examination has been passed – a corresponding mark has been made in the presto.lv profile.
5.11. Organisation and payment of the DRIVING SCHOOL'S driving examination takes place as for any driving lesson, by selecting a driving instructor with whom no training has previously taken place. Otherwise, it is counted as a regular driving lesson, and the instructor has no right to make a mark regarding completion of the driving training.
5.12. Upon arriving for the lesson, the STUDENT informs the instructor that, instead of the lesson, the STUDENT wishes to take the examination. Once it has been passed successfully, the examiner fills in a protocol in the presto.lv profile, which serves as confirmation of completion of the driving training.
5.13. After the examination, the protocol is available in the student's profile section "Documents". The examination results may be contested within 5 days by submitting a complaint to the driving school in the form of an application.
5.14. Within 5 working days after passing the examination, the data are entered into the CSDD database. This allows the STUDENT to take the CSDD practical examination, about which the STUDENT receives an informational email.
5.15. The driving school credits the STUDENT'S e-account balance with EUR 25.00 for a driving lesson before taking the CSDD practical examination, which the STUDENT undertakes to take no later than 3 days before the planned CSDD examination, or undertakes to take an additional driving lesson within the same interval.
6.1. Theory courses take place remotely using the Cisco Webex video presentation tool.
6.2. The STUDENT ensures full participation in distance learning with camera and microphone capability provided by the basic or additional (peripheral) equipment or functionality of a computer or telephone, as well as sufficient internet capacity; otherwise, attendance will not be counted.
6.3. The STUDENT receives an invitation to the first remote lesson at the email address specified in the Agreement. In the email, the STUDENT sees the lesson time and the link to join it. The link for each subsequent lesson will be available in the STUDENT'S profile under the section "Theory lessons" for each lesson; therefore, no complaints regarding non-receipt of the link by email for any reason will be accepted.
6.4. The STUDENT tries to arrive for the lesson in good time (10-30 min. before its start) in order to avoid last-minute technical problems that could hinder full participation in the lesson. In the event of problems, the STUDENT immediately contacts the driving school administration by using telephone No. +371 28813188 and email info@presto.lv.
6.5. Before entering the virtual training room by using the received link, the STUDENT indicates the STUDENT'S first name, surname and email address. The indicated data must match those specified in the Agreement.
6.6. The teacher begins the lesson by marking the attendance of the STUDENTS in the driving school's and CSDD's lesson attendance journal.
6.7. A video recording is made for lesson control purposes. By this, the STUDENT confirms consent thereto. The video recording is stored for no longer than 1 (one) month.
6.8. Theoretical training is provided remotely during the period of a state-declared emergency situation. Once the emergency situation ends, theoretical training will be conducted in person at the selected branch of the driving school.
6.9. The STUDENT is prohibited from sharing information that allows a third party to participate in the distance learning.
6.10. For each lesson, the driving school has access to data generated by the video presentation tool regarding each STUDENT'S participation in the lesson - day, arrival time, end time, duration of participation in minutes. If the DRIVING SCHOOL determines that the STUDENT has interrupted attendance for a period longer than 10 minutes, a note "Devies prom" is made in the driving school's and CSDD's attendance journal. A theory lesson is considered attended if the STUDENT has attended and listened to all prescribed study hours on that study day.
6.11. The STUDENT registers electronically for the make-up of missed theory classes using the DRIVING SCHOOL'S website presto.lv, choosing the desired branch for the make-up, day and time. Registration of the class in CSDD is carried out within 2 working days, after which the STUDENT receives a confirmation email. After receiving the email, the STUDENT is permitted to attend the scheduled theory class.
6.12. If the STUDENT cannot attend the scheduled make-up of the missed theory class, the STUDENT is obliged to cancel the booking no later than 48h before the start of the class, otherwise the money paid for the class is not refunded to the STUDENT.
6.13. Organisation of the DRIVING SCHOOL'S theory examination takes place electronically, using the DRIVING SCHOOL'S website presto.lv. Taking the examination in person at the Central District branch in Riga may take place only by way of exception, by registering by telephone No. +371 28813188 or email: info@presto.lv.
6.14. The STUDENT is admitted to the theory examination on condition that all obligations towards the DRIVING SCHOOL have been fulfilled, and that the medical certificate and the first aid certificate are valid.
6.15. The driving school theory examination may be taken once per day. It consists of 30 questions. The STUDENT may make 1 mistake; otherwise, the examination must be retaken.
6.16. For remote taking of the examination, the Cisco Webex video presentation tool on the telephone is used to provide the camera, and the Any Desk computer programme is used for remote taking of the examination on the driving school's computer. Therefore, both a telephone and a computer will be required at the same time.
6.17. The student is invited to the remote examination at the email address specified in the Agreement. In the email, the student sees the lesson time and the link to join it. The STUDENT is prohibited from sharing the link with unauthorised persons.
6.18. Before entering the virtual examination room by using the given link, the student is asked to indicate the student's first name, surname and email address again. The student indicates the student's real first name, surname and the email address specified in the Agreement.
6.19. After entering the virtual examination room, the STUDENT places the telephone against the computer monitor or computer in such a way that the STUDENT is clearly visible to the examiner from the front and that it does not interfere with taking the examination. During the examination, the STUDENT is prohibited from taking the eyes off the monitor, turning around, leaving/abandoning the examination place, talking to other persons except the examiner, as well as performing any actions unrelated to taking the examination. At the examiner's request, the STUDENT shows the room in which the STUDENT is located so that the examiner can verify the fairness of the examination.
6.20. The STUDENT presents a passport or identity card to the examiner. The examiner verifies the STUDENT'S readiness to start the examination.
6.21. The examiner asks the STUDENTS to start the Any Desk programme. The examiner gives each examinee a connection digit code by means of online correspondence, which must be entered in the Any Desk programme. Shortly thereafter, the connection will be confirmed and the STUDENT will begin taking the examination on the CSDD website in the relevant category.
6.22. If all the above-mentioned clauses of the Agreement in the section "Conduct of the online examination" are not complied with, the examiner may interrupt the examination, informing the STUDENT thereof and stating the reason (first time - warning, second time - disqualification from the examination), as a result of which the examination will not be counted as passed and must be retaken by registering for it in the manner set out in the Agreement as for a repeat examination.
6.23. After the examination, the representative of the DRIVING SCHOOL informs the STUDENT of the result of the examination.
6.24. If the STUDENT cannot participate in the theory examination, the STUDENT is obliged to cancel it no later than 24h before the start of the examination, otherwise the money paid for the examination is not refunded to the STUDENT'S e-account balance.
6.25. The DRIVING SCHOOL prepares the training card and enters these data into the CSDD database within 5 working days, after which taking the theory examination at CSDD becomes available, about which the STUDENT receives an informational email.
6.26. A video recording is made for examination control purposes. By this, the STUDENT confirms consent thereto. The video recording is stored for no longer than 1 (one) month.
6.27. If the STUDENT does not have a first aid course certificate, the STUDENT registers for and pays for the first aid courses on the DRIVING SCHOOL'S website (https://presto.lv/pirma-palidziba-kursi). Theory courses take place remotely using the Cisco Webex video presentation tool.
6.28. The STUDENT ensures full participation in distance learning with camera and microphone capability provided by the basic or additional (peripheral) equipment or functionality of a computer or telephone; otherwise, attendance will not be counted.
6.29. The STUDENT receives an invitation to the remote lesson at the email address specified in the Agreement. In the email, the STUDENT sees the lesson time and the link to join it. If the STUDENT has not received the email with the invitation 48 hours before the start of the lesson, the STUDENT is obliged to contact the DRIVING SCHOOL immediately in order to resolve the problem.
6.30. The STUDENT tries to arrive for the lesson in good time (10-30 min. before its start) in order to avoid last-minute technical problems that could hinder full participation in the lesson. In the event of problems, the STUDENT immediately contacts the driving school administration by using telephone No. +371 28813188 and email info@presto.lv.
6.31. Before entering the virtual training room by using the received link, the STUDENT indicates the STUDENT'S first name, surname and email address. The indicated data must match those specified in the Agreement.

6.34. Persons who have secondary or higher medical education or who are studying at the relevant educational institutions are exempt from first aid courses.
6.35. After the theoretical part has been completed, the driving school sends the STUDENT information regarding the place and time of the practical part. The STUDENT acknowledges that this may be delayed until the end of the emergency situation and therefore will not raise claims against the driving school. After completion of the practical part, the STUDENT will immediately be issued a certificate of completion of the first aid course.
7.1. The DRIVING SCHOOL prepares and keeps the STUDENT'S training card after the DRIVING SCHOOL'S theory examination has been passed. The training card is issued to the STUDENT upon request (by electronically filling in an application in the profile).
7.2. By signing the Agreement, the STUDENT confirms that the STUDENT has become acquainted with and agrees to comply with the DRIVING SCHOOL'S internal rules.
7.3. The DRIVING SCHOOL has the right to unilaterally amend the Agreement, giving notice thereof by telephone, in writing, or during theory lessons 10 days in advance.
7.4. The DRIVING SCHOOL has the right to terminate the concluded Agreement with the STUDENT without prior warning if:
7.4.1. the STUDENT does not comply with the payment procedure;
7.4.2. the STUDENT makes unlawful payments to the instructor for conducting driving lessons;
7.4.3. the STUDENT has provided false information for conclusion of the Agreement;
7.4.4. the STUDENT behaves aggressively during lessons or intentionally damages the DRIVING SCHOOL'S property. In such case, the STUDENT shall compensate the losses caused to the DRIVING SCHOOL within 3 working days; otherwise, the STUDENT undertakes additionally to pay a contractual penalty in double the amount of the value of the losses caused.
7.5. If either Party terminates the Agreement before its expiry, the money paid by the STUDENT shall not be refunded, except in the case specified in Clause 8.2 of the Agreement, and access to the system shall be closed.
7.6. The STUDENT agrees, and the DRIVING SCHOOL has the right, to process the STUDENT'S personal data (collection, storage, registration, entry, transfer to CSDD). The purpose of data processing is keeping records of STUDENTS and provision of services.
7.7. The Parties are not liable for non-performance of the obligations under the Agreement if caused by force majeure.
8.1. If the administrator of the DRIVING SCHOOL'S branch or the instructor does not comply with the terms of this Agreement, the STUDENT is obliged to immediately inform the management of the DRIVING SCHOOL thereof by using the telephone indicated in the details.
8.2. On the basis of a justified claim by the STUDENT, the DRIVING SCHOOL refunds the money for the relevant part of the training process. The STUDENT is obliged to submit a written claim immediately. The management of the DRIVING SCHOOL reviews it within 10 working days.
8.3. Any irreconcilable dispute arising from this Agreement shall be resolved in accordance with the procedure prescribed by the laws and regulations of the Republic of Latvia.
9.1. The Agreement comes into force at the moment of its signing. It is drawn up in 2 copies - one for the DRIVING SCHOOL, the other for the STUDENT.
9.2. The term of the Agreement is 3 years.
9.3. The Agreement is terminated if the STUDENT does not pass the DRIVING SCHOOL'S theory examination within 1 year from registration in the CSDD training group or does not obtain a driving licence within 3 years (the CSDD driving examination has been passed).
9.4. In both cases under Clause 9.3, a new training agreement is concluded for the full scope of training.
